Companies with at least 50 employees must calculate and publish their gender equality index by 1er March 2021. As a legal obligation, the index allows companies to measure gender pay equity within their organization. It highlights the areas where progress can be made when these disparities are unjustified.
This index allows the companies concerned to assess the level of equality between men and women on 100 points based on the following criteria:
- gender pay gap;
- difference in individual rate of increase;
- number of employees increased upon their return from maternity leave;
- parity among the top 10 earners;
- Promotional gap (only for companies with more than 250 employees).
Each year, the employer must:
- calculate its index using the computer simulator ;
- report it to the labor inspectorate via the website Egapro Index ;
- publish the index note on its website (or, in the absence of a website, transmit it to employees by any means), and communicate details of the results obtained to the Social and Economic Committee (ESC) via the Economic and Social Database (ESDB).
Penalties of up to 1% of payroll if the minimum score of 75 points is not reached after 3 years from the publication of 1re note or if the company does not publish its index.
To facilitate the implementation of the scheme, the Ministry of Labor has developed a free support scheme for companies with 50 to 250 employees: half-day virtual classroom internships, online self-study module, questions and answers and computer simulator.
