It is possible to request part-time in case of load shedding

In a "question and answer" on partial activity, the Ministry of Labor states that it is possible for a company in a situation of load-shedding to resort to partial activity. However, according to the department, this solution must be used as a last resort.

In the event of load shedding, the company has the possibility to place its employees in partial employment.

This solution, as stated by the Ministry of Labor, must nevertheless be used as a last resort, i.e. when the company is unable to adjust the working time of its employees in the face of this situation.

The use of part-time work for these load-shedding situations must comply with the following conditions:

  • part-time shall be used for the duration of the load shedding;
  • and, where appropriate, for the entire period necessary for restarting the production units.

In addition, load-shedding is included in derogations allowing the employer to make the request for partial activity after it has been set up. The employer will therefore have 30 days from the placement of employees in partial employment to send its prior request if the company is directly affected by a load-shedding.
