New provisions on recycled plastic intended to come into contact with food

The Decree of 23 April 2024 updates the provisions applicable to recycled plastic materials and articles intended to come into contact with food.

In order to comply with relevant EU law, the Decree of 23 April 2024 amends Article R412-38 of the Consumer Code on recycled plastic materials and articles intended to come into contact with food.

It therefore replaces the references to the repealed Regulation (EC) No 282/2008 with those relating to Regulation (EU) 2022/1616.

This new regulation lays down uniform rules on the decontamination of recycled plastic materials and articles intended to come into contact with foodstuffs (packaging, containers, etc.). This framework helps build consumer and agri-food confidence in recycled plastic.

The new provisions include in particular requirements for:

  • recycled plastic materials and articles;
  • documentation and labeling;
  • new recycling technologies;
  • recycling facilities using new technology;
  • monitoring and reporting of contamination levels;
  • the authorization of a recycling process;
  • the compliance check summary sheet and the verification of the operation of a decontamination installation;
  • the declaration of conformity.

FYI  

Failure to comply with these provisions shall be punishable by a fine of €1,500 maximum (contravention of 5e class). In case of recurrence, this amount shall be increased to €3,000 maximum.
