Class action: which courts have jurisdiction?

The decree of 16 July 2025 designates the courts competent to rule on class actions. This action allows several persons (natural or legal) to act collectively in court to obtain compensation for the same damage caused by the same person. It may also terminate the infringement concerned.

As a reminder, Article 16 of the Law of 30 April 2025 amended the class action regime. This new text, in force since May 3, 2025:

  • bring into compliance French law with European Union law;
  • unified the provisions on group shares, which have so far been broken down into different codes;
  • opens the group action to legal persons ;
  • extends the scope of class action for failures by a legal person governed by public law or by a body governed by private law entrusted with the management of a public service;
  • creates a public registry ongoing class actions held by the Minister of Justice.
