Play music to improve the customer experience in your business involves paying copyright through a collective or independent copyright management body. The most commonly used organism is Sacem: titleContent. Each year, these fees are paid back to authors, producers and performers. Their amount is determined on a flat rate basis according to your activity and theimportance of your institution.

In order to be entitled to broadcast music, you must apply for prior authorization for public broadcasting from copyright collective management organizations or independent management organizations.

Which institutions are involved?

Pricing rules apply to type establishments cafe and restaurant in the traditional catering sector.

The following establishments (which are under another scheme) are excluded :

  • Bars and restaurants with a musical atmosphere
  • Tea rooms
  • Fast food establishments

Musical broadcasts given as part of a musical animation are not affected by these rates either.

Sacem Rates

Rates are established according to the following 2 criteria:

  • Number of seated places in the establishment (including the outdoor terrace, if soundproofed)
  • Importance of catchment area (depending on the number of inhabitants of the city where the café or restaurant is located). For establishments located in Paris, a special package is applied.

If your institution does not no seating space (in the dining room or in a bar) or if the number of seats is not significant, the calculation of the fees to be paid is different. It is based on the area of the auditorium, less the area of fixed facilities (e.g. bar). In this case, one m2 corresponds to a place.

If you use a single radio set without additional loudspeaker, you have a abatement of 50%. You must also not have a sound or audiovisual media (CD, DVD, digital files) player.

However, if you use 2 or more devices in the same room (TV, stereo for example), your package is increased by 50%, unless one of the two devices is a simple radio receiver.

In addition, you benefit from a discount of 15% if your sales do not exceed €80,000 VAT for the previous financial year. This reduction shall be increased to 25% if your establishment is located in a municipality of 2 000 inhabitants or less and your turnover does not exceed €100,000 HT. You must apply for it every year and provide the supporting documents.

For seasonal establishments, where the broadcast takes place only part of the year, the rate applied shall be equivalent to 36% the annual fee for a period of up to 3 months. Beyond that, a complement of 12% the annual rate shall be applied per additional month of operation until the annual rate is reached.

Spré Rates

In addition to the fees paid to the Sacem: titleContent, you must adjust the equitable remuneration to the Spré: titleContent. It is also collected by Sacem.

Establishments whose music is broadcast fromone music source (radio or television set without additional loudspeaker) are referred to as " small cafés ” regardless of the number of seats.

Which institutions are involved?

The retail businesses concerned by these rates are the following:

  • Clothing shop, shoes, drugstore, hardware store, perfumery, jewelry store, pharmacy, delicatessen, bakery,... whatever their size
  • Grocery Store
  • Store with a floor area of 500m or less2 specialized in the sale of furniture, household appliances, DIY equipment, sanitary equipment or wholesale shop, garden, solderie
  • Street merchant
  • Supermarket with an area of 400m or less2
  • Frozen store

A shop selling food and offering customers the possibility of eating it on the spot in a space provided for that purpose shall be concerned if it complies with the following conditions:

  • The furnished space can accommodate no more than 10 people
  • Music broadcasts correspond to the general broadcasts of the establishment
  • There are no dedicated staff assigned to this space

If these conditions are not met then the applicable tariffs are the tariffs dedicated to fast food.

Sacem Rates

The amount of copyright is determined on the basis of number of employees in direct contact with customers (management, cashiers, salespeople, reception staff, entertainment staff, etc.).

Example :

For 52 employees, the general tariff is: €3,680.40+ €94.68 (package for one additional person). And the reduced rate is: €2,944.32 + €75.74.

If your establishment is open only once in every two seasons, you have a abatement of 60% on the annual rate.

  • Seasonal opening
    • 1 season: 60% of the annual rate

    • 2 seasons: 100% of the annual rate
  • Occasional opening
    • Up to 15 days: 10% of the annual rate

    • From 16 to 30 days: 20% of the annual rate

If you play music using audiovisual programs (television, video,...), the amount to be paid may not be less than €230.16 (general tariff) or €184.13 (reduced rate) HT.

Spré Rates

The amount of tax in VAT depends on the public address system and the number of employees in direct contact with the guests of the lounge.

"Extra" staff employed on weekends who also occupy vacancies on other days are included in the calculation.

If you only usea single sound source with no additional speaker, you must pay a fixed lump sum of €105.73 HT per establishment, regardless of the number of employees. small rooms to define this tariff category.

In the case of grouped reporting (more than 10 establishments) the total remuneration shall be reduced by 10%.

Spré Rates

The Sacem: titleContent collects only the equitable remuneration for the benefit of Spré: titleContent.

The amount due is obtained from a fixed package plus an amount dependent on the surface of the establishment.

The surface to be taken into account is the commercial soundproofed area open to the public, excluding warehouses and administrative premises in particular.

The prices are different for different shops general practitioners and shops specialized (furniture, sporting goods, clothing, DIY or sanitary equipment, garden centers, solderies, wholesale shops, etc.).

Example :

A department store or hypermarket with a surface area of 6,000 m² must pay an annual fee of €1,452.05HT, 106.25 + (6000 x 0.2243).

The group or string that performs a group declaration of all its stores (at least 10) shall obtain a reduction in the amount of the fee.

The amount of this reduction varies according to the number of stores and the total area of the shops:

Which institutions are involved?

The institution concerned are establishments which comply with 3 following conditions :

  • Payment at the counter before consumption
  • Use of dishware and disposable packaging
  • Freedom to consume on the spot, to take away or to be delivered

These rates apply also to the following establishments:

  • Mobile establishment selling catering from a vehicle or a removable or mobile kiosk, without reception or seat space
  • Tea room offering soft drinks and food to be consumed on site
  • Space in retail stores that can accommodate more than 10 people or have dedicated music or assigned staff. If none of the 3 conditions is met, the shop is subject to the "Store - Retail" scale.

Amount of duty payable

The amount of copyright (Sacem: titleContent) and fair remuneration (Spré: titleContent) vary depending on number of seats in your institution.

Sacem charges a lump sum to cover musical broadcasts given in the area reserved for the staff and in the where the clientele is waiting for his order.

Sacem Rates

The amount of copyright depends on the number of seats of the establishment and the number of opening days per week.

You benefit from a reduced rate (20% discount) if you are filing your return in advance, that is, before your sound equipment is installed. Otherwise, you will benefit from the general tariff.

If your institution has a operating life less than 12 months, the amount of copyright shall be calculated as follows:

  • For an open time up to 3 months : Amount is 36% of the annual reference tariff
  • For an open time more than 3 months : Amount is 36% of the annual reference tariff with an increase of 12% per additional month

If your establishment is open less than 5 days a week, the amount shall be calculated as follows:

  • For establishments open 4 days : the amount for 5 opening days per week less 15%.
  • For establishments open 3 days or less : the amount for 5 opening days per week less 20%.

If you realize an HT turnover of less than or equal to €80,000, you have a abatement of 15%. You must justify this amount using accounting documents. This reduction shall be increased to 25% if you are located in a municipality with up to 2 000 inhabitants and you have a turnover of less than or equal to €100,000.

Spré Rates

In concrete terms, it is a question of commercial establishments where it is customary to consume music.

  • Be subject to payment of VAT
  • Be subject to income tax (IR) or business tax (SI)

The amount of copyright depends on your realized turnover during the preceding business year. For new holdings, reference shall be made to the turnover shown in the forecast operating account.

  • A proportional share calculated at the rate of 2.26% (general tariff) or 1.81% (reduced rate) applicable to the amount of your turnover exceeding €750,000 HT

Example :

You realized €800,000 of turnover for the last financial year, or €50,000 beyond the last tranche. You concluded with the Sacem: titleContent a contract of representation at the general tariff.

The amount of copyright is calculated as follows: 17,246.46 + (2.26% x 50,000) = €18,376.46 to be paid.

Spré Rates

In addition to the fees paid to the Sacem: titleContent, you must adjust the equitable remuneration to the Spré: titleContent. It is also collected by Sacem.

Its amount is calculated on the basis of number of opening days per year and from capacity of the establishment.

Sacem Rates

You must pay copyright when you stream music in one or more of these situations :

  • General soundproofing of premises : halls, changing rooms, bodybuilding trays, relaxation areas, swimming pools, sauna-hammam areas, etc.
  • Music broadcast during classes : strength training, cardio-training, yoga, dance, aquatic physical activities, etc.
  • Debit rooms sound system (drinks, restaurant): located in the establishment and reserved to the guests of the establishment.

Each situation is subject to a special calculation method to determine an amount payable.

The total amount of copyright to be paid is the addition of each of these amounts.

General soundproofing of premises

It's an annual lump sum per square meter applicable to the entire area of the establishment reduced by 15%. However, the area after reduction must not be less than 200 m2.

The gym, which plays music both on its premises and during the lessons, has a abatement additional on the total area. The surface area is reduced by 35% instead of 15%.

You must pay one of the following amounts:

  • General tariff of €1.1250 per m2
  • Reduced rate of €0.9000 per m2

Example :

For an establishment of 1000 mths2 subject to reduced rate :

1. The area reduction of 15% : 1000 - (1000 x 15%) = 850 m²

2. The remaining area shall be multiplied at the corresponding rate: 850 x 0,9000 = €765

Music broadcast during classes

The amount of duty shall be calculated on the basis of the number of teaching hours data per week, per 12-hour period of courses.

You must pay one of the following amounts:

  • General tariff of €539.98 per 12 hours per week
  • Reduced rate of €431.98 per 12 hours per week

Example :

Your hotel offers 16 hours of classes per week with a physical coach. At the general rate, you have to pay €1,079.96(2 slices of 12h, i.e. 539.98 x2). Be careful, if you offer 10 hours of lessons per week you have to pay 1 tranche of 12 hours.

Sound system in debit rooms (drinks, catering)

To determine the lump sum, you must refer to the pricing rules “ Cafes and restaurants ”. Your establishment falls under the first tranche “up to 2000 inhabitants”, you must identify the number of seats.

Example :

Your establishment broadcasts music in a debit room including 32 places seats reserved for the hotel's guests. At the general tariff, the amount of copyright is €627.78.

You must add each of these amounts to get the total amount of copyright payable to the Sacem: titleContent. For example, if you don't play music in the debit rooms, the amount is not included in the final calculation.

Spré Rates

In addition to the fees paid to the Sacem: titleContent, you must adjust the equitable remuneration to the Spré: titleContent. It is also collected by Sacem.

It corresponds to 65% copyright (Sacem tariffs) and is of a minimum amount of €107.22 HT.

Which recreational areas are concerned?

The recreational areas concerned are:

  • Bowling and games room (as main activity)
  • Café and restaurant with bowling area or games
  • Karting
  • Ice rink

Are excluded all the above establishments when they carry out the consumer sale and/or restoration which fall under the tariffs applicable to them (see then information on fast food or on coffee and traditional food).

Bowling and games room

The bowling alley and/or the games room (arcade games, billiards, table football, slot machine, darts, etc.) make up themain activity of your establishment.

The amount of copyright depends on the total area (in m²) of the establishment, reduced

of 15%. The area to be taken into account is reduced by half to take into account the right-of-way of the bowling alleys.

You must pay one of the following amounts:

  • General tariff of €2.87 per m²: the minimum amount to be paid is fixed at €324.93

Café and restaurant with bowling area or games

When your café/restaurant includes games (billiards, pinball machines, video games) or bowling lanes, you must pay fees for broadcasting in the games area in addition the package that corresponds to your catering activity.

The amount of copyright depends on the number of games and/or bowling lanes what the establishment contains.

Karting

The amount of copyright is calculated on the basis of the total area (in m2) of the establishment.

Pricing rules cover the sound system of karting tracks and adjoining open spaces. On the other hand, the spaces dedicated to the drinking and/or catering facilities are subject to the ' Cafes andrestaurants , and in particular the first tranche ‘up to 2000 inhabitants’ (except on fairground holdings).

You must pay one of the following amounts:

  • General tariff of €0.59 per m2 : the minimum amount to be paid is set at €137.89

Ice rink

The amount of copyright is calculated from the turnover realized by your institution.

You will have to pay one of the following amounts:

  • General price corresponding to 1.88% gross revenue (including taxes and services)
  • Reduced rate corresponding to 1.50% gross revenue (including taxes and services)

FYI  

If the skating rink is settle only for one restricted period (example: holiday season), or if it is accessible free, the tariffs shall be subject to those applicable to go-karting.

Spré Rates

In addition to the fees paid to the Sacem: titleContent, you must adjust the equitable remuneration to the Spré: titleContent. It is also collected by Sacem.

It corresponds to 65% copyright (Sacem tariffs) and is of a minimum amount of €107.22 HT.

In order to be entitled to broadcast music, you must apply for prior authorization for public broadcasting from copyright collective management organizations or independent management organizations.

Budget less than or equal to € 5,000 and admission price up to € 20

Where the amount of revenue exceeds €7,500, the Sacem: titleContent may decide to apply the tariffs corresponding to a budget greater than €5,000.

Budget over €5,000 and/or admission price over €20

The amount of copyright shall be determined by applying a percentage of 2.50% to one of the following amounts:

  • Revenue realized (100% receipts received and 50% of ancillary revenue)
  • Budget of expenditure incurred, as a minimum guarantee and for meetings without revenue

The minimum amount of duties to be paid shall be €192.08.

Please note

If the budget amount is less than or equal to €4,000 or if the access price is less than or equal to €12, the amount to be retained shall be that corresponding to the maximum package of the corresponding installment.
