Technical Building Management Systems (TBMS)

Technical building systems (or technical building management, GTB) are technical equipment for heating, ventilation, lighting, etc. 2 types of technical systems can be mandatory in buildings for use tertiary : the building automation and control systems and the automatic temperature control systems. Explanations on the vessels concerned and the application of these obligations.
The technical building systems are the technical equipment of:
- Heating of premises
- Cooling of premises
- Ventilation
- Production of domestic hot water
- Built-in lighting
- Automation and control of buildings
- On-site electricity generation of a building or building unit, or a combination thereof, including renewable energy systems.
2 types of technical systems may be required in buildings for tertiary use. These are systems:
- D'automation and control system of building
- From automatic temperature control.
Certain buildings for use tertiary shall be equipped with a automatic temperature control system per room or, if justified, per heated area of the building.
The obligation is applicable to all buildings for tertiary use :
- Either during their construction, if the building permit has been filed since july 21, 2021 included
- Either where the installation or replacement of heat generators is undertaken since 21 july 2021 included.
Tertiary buildings are exempted if at least one the following conditions are met:
- Owners produce a study establishing that the installation of an automatic temperature control system per room or per heated area is not not feasible with a return on investment time of less than 6 years
- The heat generator of the heating system is a independent wood heating appliance.
FYI
The owners transmitters connected to the settled or replaced generator are subject to this obligation.
The buildings for use tertiary, new or existing, shall be equipped, where technically and economically feasible, building automation and control systems.
This concerns buildings that fill the 2 conditions following:
- In which tertiary activities commercial or non-commercial, including those owned by legal persons in the sector primary or secondary
- Equipped with a heating system or an air conditioning system, whether or not combined with a ventilation system, including Rated useful power is greater than 70 kW.
This responsibility applies to owners of heating or air conditioning systems in buildings.
For buildings where the generation of heat or cold is produced by heat or cold exchange with a district heating or cooling network, the power of the generator to be considered is that of the exchange station.
The application of this obligation may be immediate or deferred depending on the power of the heating/air conditioning system and the date of the building permit.

Building permit issued since July 21, 2021
All technical systems in the building must be connected to the building's automation and control system.
Building permit issued before July 21, 2021
By 1er January 2025, the building automation and control system shall be connected to:
- Heating or air-conditioning systems with a rated effective power exceeding 290 kW
- And technical systems with which the connection is feasible with a return on investment time of less than 10 years (net of public financial aid).

Building permit issued since April 8, 2024
All technical systems in the building must be connected to the building's automation and control system.
Building permit issued before April 8, 2024
Where the heating or air conditioning system is subject to renewal and no later than 1er January 2027, the building automation and control system shall be connected to:
- Heating or air-conditioning systems with a useful rated power exceeding 70 kW
- And technical systems with which the connection is feasible with a return on investment time of less than 10 years (net of public financial aid).
Please note
Vessels subject to the obligation may be exempted if they have a study establishing that the installation of an automation and control system is not feasible with a return on investment time of less than 10 years. The method of calculating the return on investment is detailed in an order.
Operation
Building automation and control systems shall:
- Continuously track, record and analyze, by functional area and at an hourly time step, energy production and consumption data technical systems of the building to which they are connected
- Adjust technical systems as a consequence of the data analyzed
- Situate the energy efficiency of the building against reference values, corresponding to the data of energy studies or characteristics of each of the technical systems to which they are connected. They must detect loss of efficiency technical systems and inform the operator building opportunities for energy efficiency improvements.
- To be interoperable with the different technical systems of the building to which they are connected
- Allow a manual shutdown and the self-management one or more technical building systems to which they are connected.
The data produced and archived must be accessible to the owner of the automation and control system, who owns it. These data, detailed by month, must be kept for 5 years.
Please note
The owner of the automation and control system shall make this data available to the building manager at his request. It must also transmit the data concerning them to each of the operators of the various linked technical systems.
Periodic Checks
Building automation and control systems must be subject to periodic checks by an external contractor or competent internal staff, with a view to ensuring that they remain in good working order.
These checks are framed by written instructions data to the building automation and control system manager. These instructions must:
- Specify the frequency of interventions
- Specify the points to check
- Provide for the prompt repair or replacement of defective parts of these automation and control systems.
Please note
Some controls and inspections of technical systems are not not mandatory for those connected to an automation and control system. These are the controls and inspections planned for:
- Boilers
- Thermodynamic systems
- Ventilation systems combined with Joule effect heating with a rated output greater than 70 kW.
The owner of the automation and control system must ensure that its operator is trained its operation, in particular as regards its parameterization.
Periodic inspections
At the initiative of their owner, building automation and control systems shall be subject to periodic inspection.
THEinspection includes:
- If it's 1re system inspection, a review of the functional analysis of the system
- A verification of the proper functioning of the system
- An assessment of compliance with the requirements specific to automation and control systems
- Unless the system inspected, the related technical systems and the requirements of the building have not changed since the last inspection, an assessment of the system's configuration in relation to the use of the building
- Providing the necessary recommendations on the proper use of the system in place
- Possible improvements to the entire facility, the potential value of replacing the facility, and other possible solutions.
Periodic inspection of an automation and control system includes on-site visit which must take place on a running installation, partial or total. This visit focuses on the accessible parts of the automation and control system elements of buildings and technical systems present in the building.
Within one month, the person who carried out the inspection shall submit a report the owner of the automation and control system, who shall store for 10 years.
The inspection report includes the following:
- Results of the document audit and evaluation of the requirements for the automation and control system
- Necessary recommendations on the proper use of the existing system
- Possible improvements to the entire installation
- Possible need to replace the automation and control system or the entire installation
- Other possible solutions.
The frequency periodic inspections shall be less than 5 years.
This frequency is reduced to 2 years following installation or replacement:
- The building automation and control system
- One of the technical systems linked to the building automation and control system.
FYI
The 1re inspection the existing building automation and control system as of 7 April 2023 must have been completed no later than 1er January 2025.
Some closure systems manual or automatic limiting heat losses must be settled to the openings of any building, or part of a building, in which tertiary activities are carried out. This applies to any room heated or cooled using one or more heating or air conditioning systems, overlooking outdoor areas or an unheated or cooled part of a building.
Under normal operating conditions, when one or more of these heating or air-conditioning systems are in operation, these closing systems shall be kept closed by the operator, including during the hours of operation for users.
This provision does not apply where:
- Either indoor air renewal requirements require it (indoor air pollution prevention)
- Either the recommendations of the health authorities recommend it.
Warning
Some controls may be carried out, under the authority of the mayor or the president of theEPCI: titleContent. It shall send the operator a formal notice comply with its obligations and invite it to submit its observations within a maximum of 3 weeks. In the event of continued non-compliance with this obligation, the operator is at risk of administrative fine of €750.
