Obligation to install bicycle parking facilities

The installation of bicycle parking facilities is mandatory during the construction of certain buildings, parking lot works. The obligation shall also apply to all existing buildings for tertiary use. We're explaining the regulations.

Constructions

Facilities for secure bicycle parking must be settled during the building of:

  • Residential complexes equipped with individual covered parking spaces or secure access
  • Buildings for industrial use or tertiary mainly a workplace and equipped with parking spaces for employees
  • Public service buildings equipped with parking spaces for agents or public service users
  • Buildings forming a commercial complex or accommodating a cinema equipped with parking spaces for customers.

Works

Infrastructure for secure bicycle parking must be settled in parking lots during their work.

The obligation shall apply to the following conditions:

  • Infrastructure whose annex car park includes at least 10 places
  • When the projected total cost of work is greater than or equal to 2% the value of the building(s). This value is determined by the product of the cost of construction and the floor area.

This obligation concerns:

  • Residential complexes (with at least 2 accommodation units) equipped with individual covered parking spaces or secure access
  • Buildings for industrial or tertiary use equipped with parking spaces for employees
  • Public service buildings equipped with parking spaces for agents or public service users
  • Buildings forming a commercial complex or accommodating a cinema equipped with parking spaces for customers.

By way of derogation, this obligation does not apply where at least one of the following occurs:

  • When no available space capable of accommodating the required infrastructure is accessible by a cyclist from the public space. This exemption does not apply where access to such space can reasonably be adapted to be used by a cyclist safely.
  • Where the reduction in the number of parking spaces resulting from the installation of such infrastructure would prevent compliance with the minimum obligations imposed by the local city planning plan (PLU).

Existing buildings for tertiary use

Infrastructure allowing secure bicycle parking must be settled in existing buildings for tertiary use where they are:

  • Consisting mainly of premises for professional use
  • Equipped with at least 10 parking spaces intended for workers.

Please note

This obligation also applies to any co-owner whose condominium lot or lots include at least 10 places for workers in a private part.

By way of derogation, this obligation does not apply where any of the following occurs:

  • When all available spaces capable of accommodating the required infrastructure are inaccessible by cyclists from the public space. This exemption does not apply where access to such space can reasonably be adapted to be used by a cyclist safely.
  • Where the reduction in the number of car parking spaces resulting from the installation of such infrastructure would prevent compliance with the minimum obligations imposed by the local city planning plan (PLU) (e.g. pedestrian traffic).

The minimum number of required locations depends on the type of building:

New buildings with parking spaces

Housing assembly

In new housing complexes (one or more buildings, with a main residential use grouping at least 2 dwellings), the minimum number of compulsory pitches corresponds to:

  • 1 location per housing of 1 or 2 main rooms
  • 2 locations per dwelling from 3 main rooms.
Buildings for industrial or tertiary use

In new buildings for industrial or tertiary use (mainly a place of work), the minimum number of compulsory places corresponds to 15% of the total number of employees accommodated simultaneously in the building.

Public service buildings

In new public service buildings, the minimum number of compulsory pitches shall be:

  • 15% of the total number of agents the public service accommodated simultaneously in the building, for the spaces reserved for them
  • 15% of the total number of users public service facilities accommodated simultaneously in the building, for the spaces reserved for them.
Buildings forming a commercial complex or accommodating a cinema

In new buildings forming part of a commercial complex or housing a cinema, the minimum number of compulsory pitches corresponds to 10% parking capacity.

The obligation applies to a maximum of 100 locations.

Existing buildings with an annex parking lot under construction

Housing assembly

In housing complexes (comprising at least 2 dwellings) which are the subject of work, the minimum number of compulsory pitches corresponds to 1 location per dwelling.

Reminder

The obligation only applies to buildings that have at least 10 parking spaces for motor vehicles.

Buildings for industrial or tertiary use

In buildings which are the subject of industrial or tertiary work (mainly a place of work), the minimum number of compulsory places corresponds to 10% of the total number of employees accommodated simultaneously in the building.

Reminder

The obligation only applies to buildings that have at least 10 parking spaces for motor vehicles.

Public service buildings

In buildings undergoing work on public services, the minimum number of compulsory pitches shall be:

  • 10% of the total number of agents the public service accommodated simultaneously in the building, for the spaces reserved for them
  • 10% of the total number of users public service facilities accommodated simultaneously in the building, for the spaces reserved for them.

When outside the building, bicycle parking facilities for users must be located within 50 meters of the main entrance(s) of the building.

Reminder

The obligation only applies to buildings that have at least 10 parking spaces for motor vehicles.

Buildings forming a commercial complex or accommodating a cinema

In buildings which are the subject of works forming a commercial complex or which house a cinema, the minimum number of compulsory pitches corresponds to 10% parking capacity.

The obligation applies to a maximum of 100 locations.

When outside the building, bicycle parking facilities must be located within 50 meters of the main entrance(s) of the building.

Reminder

The obligation only applies to buildings that have at least 10 parking spaces for motor vehicles.

Existing buildings for tertiary use and consisting mainly of premises for professional use

In existing buildings for tertiary use and consisting mainly of premises for professional use, the minimum number of compulsory places corresponds to 10% of the total number of workers accommodated simultaneously in the building.

Reminder

The obligation only applies to buildings that have at least 10 parking spaces for motor vehicles.

The infrastructure allowing secure bicycle parking must have in any case of a minimum of 2 slots.

General characteristics

The infrastructure shall include fixed facilities for stabilize and attach the bikes by the frame and at least one wheel.

These facilities are located or distributed on the same land unit, preferably on the ground floor or 1er basement of the parking lot, building or housing complex.

Each location induces a parking area of 1.5 m2 at least, excluding clearance space.

Please note

Where the infrastructure is installed by conversion of existing car parking spaces into rental, it shall be carried out at the earliest after the end of the lease of the places concerned, otherwise with the agreement of the tenant.

Securing

Infrastructure for occupants, employees and public officials

Access to bicycle parking facilities is provided by a door having a secure closure system (locks, padlocks, etc.) when intended for:

  • Occupants of a housing complex
  • Workers in a building for industrial or tertiary use which is principally a place of work
  • Agents of a building hosting a public service.

Please note

Where such infrastructure is located outside a building, it shall be covered, lit and closed.

Infrastructure for customers and users of public services

The security of bicycle parking infrastructure is ensured by a functional monitoring or by a door having a secure closure system (lock, padlock, etc.), when intended:

  • To users of a public service building
  • To the customers of a building constituting a commercial complex or hosting a cinema.

Functional monitoring may be carried out by:

  • Either a person present on the premises who has a direct view of the infrastructure
  • Or through a video surveillance system.

Please note

When located outside the building, these facilities are covered and lit.
