Prevention and treatment of difficulties: what are the key players?

When the company's difficulties are proven, several procedures can be put in place depending on the situation. Some are so-called amicable procedures: they allow for quick renegotiations with certain creditors. Where the difficulties are more severe and the company is in default of payments, it is directed towards judicial recovery or liquidation. We present the actors involved in this phase of prevention and treatment of difficulties.
Commercial and Judicial Courts
The courts are the preferred interlocutors in case of difficulty.
They can be seized when setting up preventive amicable settlement procedures to appoint an ad hoc trustee or conciliator. They also intervene when the company can no longer meet its liabilities in the context of a safeguard procedure or in the event of a cessation of payments to trigger the judicial recovery or liquidation procedures.

Administrators and judicial representatives (AJMJ) are independent experts who defend the interests of the company in difficulty in order to safeguard jobs.
The AJMJ assists the leader in selecting and implementing the solutions best suited to his or her difficulties.

RE-CREATE accompanies struggling entrepreneurs by offering them moral and practical support to help them bounce back.
It is made up of volunteers (former managers or judges of the Commercial Court) who are available to listen to the entrepreneur, answer his questions and allow him to benefit from the experiences of other entrepreneurs. All that can be said during these exchanges is confidential.
It proposes several types of support :
