Pesticide ban: new places affected since 1 July 2022

The Labbé law prohibiting the use of plant protection products in public green spaces is evolving. Since 1er in july 2022, it applies to private property, public use and public use.

Since 1er January 2017, the state, local authorities and public institutions can no longer use plant protection products to maintain green spaces, walks, forests and roads.

From 1er in july 2022, the prohibition on the use of plant protection products extends to new places

  • private properties for residential use, including their outdoor and leisure areas;
  • hotels, group hostels, accommodation, campgrounds and residential leisure parks;
  • cemeteries and columbariums;
  • family gardens;
  • amusement, entertainment and leisure parks offering a variety of activities and facilities;
  • areas accessible to the public in areas intended for trade and service activities;
  • private access roads, green areas and rest areas at the workplace (except where necessary for safety reasons);
  • areas for collective use by educational establishments;
  • health facilities, nursing homes, and health centers, including their open green spaces, forests, roads, or walks accessible or open to the public;
  • social and medico-social establishments, with the exception of establishments providing or participating in vocational training, or carrying out work-related activities potentially leading to the use of such products, including their green spaces, forests, roads, or walks accessible or open to the public;
  • maternity homes and homes of maternity assistants accommodating minors, including their green spaces;
  • aerodromes primarily assigned to the Ministry of Civil Aviation, on the city side, on certain spaces and airside, except for areas where processing is necessary for reasons of aviation safety or airport security;
  • sports equipment other than:
    1. large-scale playgrounds, horse-race tracks and turf tennis courts, access to which is regulated, controlled and reserved for users;
    2. golf courses and practices of golf, it is only about departures, greens and fairways.

For these sports equipment, the ban on the use of plant protection products will only be in force from 1er January 2025.

Please note

Biocontrol products, low-risk qualified products and products authorized for use in organic farming are not affected through these new bans.

FYI  

The prohibition on the use of plant protection products shall not apply to:

  • the treatments and measures necessary for the destruction and prevention of the spread of regulated pests;
  • treatments with plant protection products which prove necessary to combat a serious health hazard threatening the survival of the historic or biological heritage and which cannot be controlled by any other means, including a non-chemical method.
