Arce and ARE: amendments as of April 1, 2025

Under the new unemployment insurance agreement approved by decree, new rules are applicable to aid for the takeover or creation of a company (Arce) and aid for the return to work (ARE) from 1er April 2025. Explanations.

As a reminder, the CRA is a financial aid conditionally paid by France Labor company creators or buyers.

The Arce is collected in 2 installments 6 months apart:

  • the first payment corresponds to half of the aid and is made when the conditions for obtaining the Arce are fulfilled;
  • the second payment shall be made if the transferee or creator still pursues his professional activity.

What changes?

There are a number of changes that will take place with respect to the payment of the CRA. These new measures will apply to all companies created or taken over from 1er April 2025.

Obligation not to engage in full-time CDI in order to receive the second installment of the CRA

Until now, in order to benefit from the second installment of the Arce, the only condition to be met was to attest that one is still working.

From now on, the second installment will also be subject to the condition that the employee does not work full-time on a permanent contract.

Recovery of entitlement to the ARE subject to the end of self-employment

Reminder

L'return-to-work assistance allowance​ (ARE) and the Arce are not cumulative.

At present, it is possible for a person who has benefited from the CRA to apply for his entitlement to the RCA after having received the second installment of the CRA.

From now on, the person wishing to benefit from a takeover of the ERA will have to obligatory to have ceased his professional activity.

In other words, if the company set up by the beneficiary exists after the payment of the CRA, he will not be able to claim his rights back from the RCA.

Finally, in the event that the beneficiary has ceased its activity, the resumption of the payment of the AER will take place after a delay, which was not the case before.

Monthly payment of RARE

Currently, the monthly amount of the PPA paid varies according to the number of days in the month.

From 1er April 2025, the RARE payment will be monthly on one fixed base of 30 calendar days whatever the month. The the amount of the allowance will therefore no longer vary depending on the number of days in the month.
