The manager can now protect the information relating to his personal home

Business managers can now request the confidentiality of information relating to their personal residence. This measure aims to protect leaders from the risks of physical assault, harassment or cyber attacks.

The decree of August 22, 2025 allows business executives to hide their personal address on the Trade and Companies Register (RCS). The leaders concerned are the natural persons, legal representatives of business, and partners indefinitely liable for legal persons (for CNS: titleContent and civil businesses). These persons may also request the confidentiality of their personal address on acts of the company (past and future), as well as on the extract K or Kbis.

This request is made on the company formalities window. It is then processed by the Registrar of the Commercial Court within 5 working days of its receipt.

If the Registrar is silent, it is possible to refer this request to the judge responsible for the supervision of the register.

Please note

Furthermore, Article L. 123-52 of the French Commercial Code protects the personal data of natural persons in the National Register of companies (RNE) by stipulating that only the municipality of residence is published.

In the case of individual entrepreneurs, it is possible to exercise the right to object to the publication of the address of the principal place of business where that address is the same as the address of the personal domicile. This request is made to INSEE.

Who will be able to access personal home information?

From now on, information relating to the personal address of the manager will only be accessible to the following persons and entities:

  • judicial authorities;
  • the legal representatives of the business;
  • business partners;
  • the creditors of the natural persons in charge;
  • the national financial intelligence unit;
  • customs administration officials;
  • public finance administration officials responsible for monitoring and collecting tax matters;
  • judicial police officers of the national police and the national gendarmerie;
  • authorities, administrations, legal persons and professions referred to inArticle R123-318 of the French Commercial Code (excl. networks of chambers of commerce and industry, chambers of crafts and crafts and chambers of agriculture);
  • for companies falling within their remit: the presidents of the chambers of trades and crafts and the departmental and multi-departmental agricultural social mutuality funds;
  • the Union for the Recovery of Social Security Contributions and Family Allowances designated by the Director of the Central Agency of Social Security Bodies.
