You have obtained a city planning authorization (prior declaration, building permit for example) to carry out work and your work is completed? You must complete a Declaration of Completion and Compliance (ACCA). It allows you to inform the city hall of the end of your work. You attest to their compliance with the city planning authorization obtained.

Step-by-step approach

If you have obtained a city planning authorization (advance work declaration, building permit or development permit) and your work is completed, you must file a CTAA.

Please note

you must declare the complete or partial completion of the work. Partial completion concerns work in installments, originally foreseen by the city planning authorization. At the end of each installment, you must complete an ACSI.

You must sign the ACAD or have it signed by the architect when he or she led the work.

Depending on the project, you must attach certificates to the ACFD certifying compliance with certain construction rules.

Accessibility certificate

You must provide an accessibility certificate in the following cases:

  • Construction of a detached house to be rented or made available or to be sold
  • Construction of a public housing building or a new part of a public housing building
  • Construction of a building for collective housing or a new part of a building for temporary or seasonal occupation
  • Work in an existing multi-family dwelling building where housing units are created by change of destination
  • Work in an existing collective housing building or in an existing building where housing for temporary or seasonal occupancy is created
  • Building or creating a ERP: titleContent
  • Work within an existing ERP or create an ERP within an existing built-in framework

The certificate shall be drawn up by a technical inspector or an architect. The architect cannot be the one who designed the project or drew up the plans or signed the application for a building permit.

Certificate of acceptance of environmental regulation RE2020 and thermal RT2012

You must provide a RE2020 and Thermal (RT2012) environmental compliance statement for the new construction or extension of buildings.

Warning  

You do not have to provide a certificate for energy renovation works on an existing building. However, it must comply with the thermal regulations that apply to existing buildings (RT “global” or RT “elements”) and can still be subject to regulatory control.

The ‘overall’ thermal regulation applies to existing residential and tertiary buildings with a surface area of more than 1000 m² that are subject to major renovations.

The thermal regulation ‘elements’ applies to existing residential and non-residential buildings with the exception of those subject to the measures concerning heavy renovations.

Certificates of acceptance of environmental regulations RE 2020 and thermal RT 2012

The certificate shall be drawn up by a technical inspector or an architect.

The architect cannot be the one who designed the project, drew up the plans or signed the application for a building permit.

For single-family homes, a certified energy performance diagnostic (EPR) diagnoser can write this attestation.

Acoustic certification

For new residential buildings or single-family houses attached to or superimposed on another premises, you must provide an acoustic attestation.

It shall attest to compliance with the acoustic regulation.

It shall be drawn up by an architect, the supervisor, an approved technical inspector, a consultancy or an acoustical engineer.

Paracyclonic and parasismic attestation

In areas exposed to a seismic or cyclonic risk, a technical controller certifies that the seismic and paracyclonic construction rules are complied with.

  • By dematerialized according to the arrangements made by your municipality (inquire on the site of the town hall or on the spot)

The City Hall can challenge the conformity of your building with the city planning authorization, by checking on the spot, for a period that varies according to the location of your building.

Your project may be located in a safeguarded area, an area with a historical, aesthetic or nature that justifies the conservation, restoration and presentation of all or part of a set of buildings.

Your project may also be located in an area exposed to natural, technological or mining risks (for example, a landslide, a flood zone or a nuclear risk).

General case

The city hall has 3 months to challenge the conformity of the works from the date of receipt of the ACSI.

Historical monument or sector saved

The city hall has 5 months to challenge the conformity of the work on a building registered under historic monuments or monuments located in a protected area from the date of receipt of the ACT.

Natural, technological or mining hazards

The city hall has 5 months to challenge the conformity of works in an area covered by a natural, technological or mining risk prevention plan from the date of receipt of the ACFD.

If your construction is not in conformity, the city hall can give formal notice, by post RAR: titleContent, to carry out the necessary work. For this, she may ask you to table a modification building permit.

Warning  

if regularization is impossible, the city council can impose the demolition of the building.

Without a response from the City Hall within the deadline, the work is considered complete and compliant.

The method of obtaining an attestation of non-challenge differs depending on whether you are in the province or in Paris.

General case

If you wish to obtain an attestation of non-challenge, you must ask the city hall.

This request must be sent to the City Hall by simple or registered mail. The certificate is issued under 15 calendar days from the receipt of your request.

If the city hall does not send you this certificate or if it does not reply to you, you must make the request to the prefect of the department where the construction is located.
