Mandatory records in the company

The employer must keep several records in the company. We provide an update on regulations, the content of registries, and penalties for non-compliance.

A personnel register must be opened as soon as you hire your 1er salaried worker.

No specific shape is imposed, but certain particulars are mandatory.

This register may be in digital form after consultation of the Social and Economic Committee (ESC).

It shall be made available to the Labor Inspectorate and the members of the EESC.

Content of the single staff register

The information to be specified in the single staff register differs according to whether the employee is an employee, a trainee or a volunteer on civic service.

Information concerning employees

The mandatory particulars concerning employees are as follows:

  • Surname and forenames
  • Nationality
  • Date of birth
  • Sex
  • Employment
  • Qualification
  • Dates of entry and exit
  • Where authorization to hire or dismiss is required, the date of such authorization or otherwise the date of the application for authorization
  • For foreigner workers in respect of whom a work permit is required, the type and serial number of the permit to work
  • For workers under fixed-term employment contracts, the term ‘fixed-term contract’
  • In the case of temporary employees, the term ‘temporary employee’, the name and address of the temporary company of work
  • In the case of workers made available by an employer group, the words ‘made available by an employer group’, the name and address of the employer group
  • For part-time employees, the term ‘part-time employee’
  • For young workers on an apprenticeship or professionalization contract, the words ‘apprentice’ or ‘professionalization contract’

Information about trainees

Trainees must be mentioned in a specific part of this register.

The mandatory particulars concerning trainees are as follows:

  • Surname and forenames
  • Start and end dates of the on-the-job training period or internship
  • Surname and forenames of the tutor and place where the trainee is present

The information must be entered in the order of arrival.

Volunteers in civic service

Civic service volunteers should be mentioned in a specific part of this register.

Names and forenames of civic service volunteers shall be entered in the order of arrival.

Documents annexed to the register

Employees seconded by a foreign company

For employees posted by a foreign company, the posting declaration must be annexed to the register of the company in which the posted employees are posted.

Foreigner employees

A copy of the documents authorizing foreigner workers to pursue an activity as an employed person shall be annexed to the register.

It shall be made available and accessible to the Labor Inspectorate and members of the ESC: titleContent as well as the control officers of Urssaf: titleContent.

It shall be made available to them either in the establishment or at each site or workplace separate from the establishment for those of the foreigner workers who work there.

Sanction in the absence of a single staff register

The absence of a register, the absence of updating or the omission of mandatory particulars may lead to €750 fines per employee concerned.

The employer must establish a DUERP.

The DUERP shall be made available, in particular, to the members of the ESC: titleContent and labor inspection.

Content of the Single Occupational Risk Assessment Document (DUERP)

This document lists all the occupational risks to which company workers are exposed.

The results of the health and safety risk assessment of employees should be listed and updated in this document.

Sanction in the absence of a Single Occupational Risk Assessment Document (DUERP)

Failure to update the DUERP may result in a contravention of €1,500 (€3,000 in case of recurrence).

It's a special register with numbered pages. He shall be required, under the responsibility of the employer, to be available to the members of the staff delegation to the ESC.

The alert shall be recorded in writing. It must be dated and signed.

Please note

Where the company has several work sites, a single register shall be set up provided that there is only one CSE.

Who can fill in this register?

The following people can give the alert:

  • Staff Representative at the EESC, which establishes directly or indirectly that there is a serious risk to public health or the environment
  • Employee which considers that the company is using products which present a serious risk to public health or the environment

The situation should be discussed with the staff representative who forwarded the alert. The employee must be informed of the action the employer intends to take on this alert.

What is the content of the public health and environmental alert register?

The following information shall be recorded:

  • Products or manufacturing processes used or carried out by the establishment which the worker considers in good faith to present a serious risk to public health or the environment
  • Potential consequences for public health or the environment
  • Any other information relevant to the assessment of the recorded alert

What is the penalty for not having a register of public health and environmental alerts?

Failure to register alerts on public health and the environment may result in a fine of €10,000.

Repeated offenses shall be punishable by imprisonment for one year and a fine of €30,000. The fine shall apply to each employee concerned.

In companies with less than 50 employees where a ESC: titleContent, a register is required.

It is made available to employees, the labor inspectorate and members of the staff delegation to the EESC.

Content of the ESC Question Register

This register shall contain the written requests members of the staff delegation to the EESC and reasoned responses of the employer.

Sanction in case of absence from the CSE's register of questions

The absence of a register constitutes a obstruction offense the functioning of the EESC. This can be punished with a fine of €7,500.

The ESC: titleContent indicate on a special register all serious and imminent danger.

The pages of this register are numbered and authenticated by the CSE buffer.

This register shall be kept at the disposal of the members of the ESC under the responsibility of the employer.

Contents of the register of serious and imminent hazards

The ESC: titleContent indicate on the register the following information:

  • Workstation concerned by the cause of the identified hazard
  • Nature of the hazard observed
  • Name of exposed workers

Sanction in the absence of a register of serious and imminent dangers

Failure to keep a register of serious and imminent dangers may be punished by a fine of €10,000.

Repeated offenses shall be punishable by imprisonment for one year and a fine of €30,000. The fine shall apply to each employee concerned.

Where all employees of the company do not benefit from the same weekly day of rest (e.g. on Sundays), a special register shall indicate the names of the employees subject to this special rest arrangement.

It shall be kept at the disposal of the labor inspectorate concerned during its visit.

This register shall be made available to employees who so request.

Content of the special weekly rest register

It specifies the weekly day of rest for each employee. This register shall be updated when the weekly rest period is changed.

Penalty in the absence of a special weekly rest record

The absence of a special weekly rest register may be punished by a fine of €1,500 per employee concerned.

In the case of shift, shift or shift work, a register or table shall be kept up to date.

It shall be at the disposal of the labor inspection supervisor and members of the staff delegation to the ESC: titleContent.

Please note

Employees provided by a temporary company of work shall be entered in this register.

Contents of the table or register

This register or table shall indicate the nominative composition of each team.

Sanction in the absence of a register or table organizing the team work

The absence of a register or table organizing the team work can be punished with a fine of €1,500 per employee concerned.

This register shall be kept at the disposal of the labor inspectorate.

Contents of the electrical verification register

This register shall contain the results of the electrical checks, the justifications for the work carried out and the modifications made to correct the defects found.

Documents annexed to the register of electrical checks

Reports resulting from these verifications carried out by an accredited body shall be annexed to this register.

In case of hiring a homeworker, the employer must complete a register of the accounts for the raw materials and supplies intended for the worker.

It shall be made available to the labor inspectorate.

Contents of the accounting register of homeworkers

Upon entry into the establishment, the register shall contain the following information:

  • Date of entry
  • Quantity
  • Nature of each item

When the work is handed over to the workers, the register must contain the following information:

  • Date of delivery
  • Quantity
  • Nature of each item
  • Nature of the work
  • Worker Name

On delivery of the work by the workers, the register must include the date of delivery.

Penalty in the absence of documents concerning homeworkers

Failure to keep records of homeworkers' accounts may result in a fine of €450

Any company that performs data processing at obligations regarding the protection of personal data (GDPR).

It makes it possible to identify all the processing of personal data: payroll management, human resources management, commercial prospecting, publication of a photo of a person on a website, etc.

For each treatment activity, the register file shall contain at least the following elements:

  • Name and contact details data controller
  • Purposes of treatment
  • Categories of persons concerned
  • Categories of personal data (examples: identity, family, economic or financial situation, banking data, connection data, location data)
  • Recipient Categories to which the personal data have been or will be communicated
  • Transfers personal data to a third country or an international organization and, in very specific cases, guarantees provided for such transfers
  • Time limits for erasure the different categories of data, i.e. the retention period, or otherwise the criteria for determining it
  • General description of security measures technical and organizational implementation
