Definition

L'energy renovation attendant is one trusted interlocutor during major renovation works. It is state-approved and offers personalized support. It evaluates with the household needs, help to mobilize aid, including MaPrimeRénov', to finance the work and ensure its quality and consistency with the energy audit.

It is also named “ My Companion Renovo' ”.

It supports the household throughout its work path by offering technical, administrative, social and financial support. It intervenes through the following missions:

  • Definition of the work project : visit of the dwelling, performance or subcontracting of the energy audit, support on the choice of the work scenario, advice on the work
  • Support on the submission of the aid application and to mobilize the various national and local aids, in order to reduce the remaining costs
  • Tips for selecting ‘Recognized Environmental Guarantor’ (EGR) companies and the choice of quotes
  • Identification of special situations, particularly of precariousness
  • Verification of concordance  between the chosen work scenario and the work carried out
  • Advice at the end of the project and explanation of eco-gestures.

Access

The following people may be approved :

  • The natural persons
  • The legal persons governed by private law, in one of the following forms: SARL, EURL, LOCK or SASU

The following people shall not be approved :

  • Placed in receivership or liquidation
  • Definitively sentenced for a crime or to a sentence of at least 3 months' imprisonment without suspension for an offense related to one of the following grounds: fraud, breach of trust, concealment, laundering, corruption, influence peddling, forgery, participation in a criminal association, drug trafficking, pimping, bankruptcy, tax fraud, etc.
  • Who have not made the declarations incumbent upon them in respect of tax or social matters or have not paid the taxes, contributions or social contributions payable.

Any operator wishing to be authorized must complete a condition of independence with regard to the execution of a work in the field of energy renovation.

As such:

  • The applicant proves that he is not in a position to sign work contracts with the household
  • The applicant demonstrates the absence of a business contract linking him with a company of execution of the work.

The activities of the project supervisor shall be compatible with these conditions of independence.

Conditions of competence

Persons wishing to exercise the profession of energy renovation attendant must meet one of the following conditions :

  • Be architect
  • Holder of the quality sign ‘RGE global offer’ issued by a qualification body, intended for professionals trained and capable of designing global energy renovation offers
  • Be a qualified energy auditor
  • To be a territorial authority or a group of territorial authorities
  • Be a Consulting Space France Rénov'
  • Have the quality of third-party financing business (owned by at least 50% of public capital)
  • Be a registered operator of the National Housing Agency. This shall apply if the authorization permits the exercise of social, financial and technical engineering activities.
  • Be a structure contributing to the implementation of a planned habitat improvement operation, or a program of general interest for habitat improvement.

Submission of the file to the National Housing Agency

Examination of the application and issue of the approval

L'Anah: titleContent or its local delegation examine the application for authorization ensuring the validity of the following criteria:

  • The file contains all the documents. The instructor service will make a request for missing parts and, if necessary, additional parts. It shall set a time limit of one month for the submission of such documents. Failure to provide the documents requested within the time limit shall result in rejection of the request.
  • The applicant may be approved
  • The file is compliant
  • The planned activity program shall be consistent with the level of human resources deployed for the accompanying mission and with the accompanying activity declared as full-time or part-time
  • The declared scope of intervention is consistent with the territorial locations indicated.

The National Housing Agency or its local delegation can then to grant approval. The decision to grant authorization shall state the following:

  • Date of grant
  • Date of expiry of the approval
  • Referencing scope chosen on the national information system
  • Obligations of the energy renovation attendant, including a reminder of the authorized subcontracting conditions and the obligation to use the wording “My Renovated Attendant” in the documents of quotation, invoice, communication and prospecting
  • Possible penalties for non-compliance
  • Reminder to communicate to the National Housing Agency before 31 March of each calendar year, the annual report justifying in particular the respect of the conditions of independence of the accompanying person
  • The reminder to favor efficient and comprehensive renovations.

For an initial or renewal application, the approval shall be granted for a period of 5 years.

The approval is granted by express decision of the National Housing Agency for a maximum duration of 5 years renewable, in a period of 3 months from the date of submission of the file. The Agency's silence at the end of this period shall be deemed to constitute an implied decision rejecting the application.

Accreditation is valid :

  • On the national perimeter, for natural and legal persons
  • Within the territorial jurisdiction of the territorial collectivity or grouping of territorial collectivities, for businesses of third party financing

In case of incomplete file, the National Housing Agency shall send the person concerned a request for additional documents. The time-limit for examining approval shall be suspended until the requested additions are received. The application for approval may be rejected if a file remains incomplete after 1re request for add-ins.

After studying the supporting documents, in the event of a legitimate and persistent doubt as to the capacity or independence of the operator, or if the documents transmitted do not meet the requirements laid down by the applicable regulations, the National Housing Agency may refuse to grant approval.

Exercise

The registration of the activity concerns the accompanying persons who do not have a Siret number.

Registration must be done online on the website of the company Formalities Office after the signature of the statutes and the publication of an official notice in a legal announcement journal (the deadline is 15 days after the start of activity for individual companies):

Only the following persons may be approved:

This declaration is used to inform all the organizations concerned by the launch of your activity (Insee: titleContentsocial organizations, Urssaf: titleContent, Center for Public Finance...).

Insee shall assign a Siret number. This is a unique national identification number that identifies the establishment. It is composed of Siren (first 9 digits) which identifies the company and the Nic (last 5 digits) which is modified in particular when the address of the establishment is changed.

When registering the company, Insee also attributes to the accompanying person his or her EPA code. For the activity of energy renovation accompanying person, the EPA code is 71.12B.

From the start date of the activity, the energy renovation attendant pays social contributions to theUrssaf: titleContent. They are calculated on the basis of realized income.

These contributions are must be paid online in one of the following ways:

  • Either every month. The monthly payment is made on the 5th of each month (or the 20th on option) by direct debit.
  • Either every quarter. The quarterly payment is made by direct debit, by electronic payment or by credit card. Contributions are payable for February 5, May 5, August 5, and November 5.

Social contributions are calculated on the basis of self-employment income.

The accompanying service must comply with the following conditions :

  • The service is provided by an authorized energy renovation attendant
  • The subcontracting of accompanying services is prohibited, with the exception of:
    • The subcontracting of the entire service entrusted to another certified energy renovation attendant
    • Energy audit
    • Enhanced delivery
  • The cumulation of subcontracts is prohibited, with the exception of the enhanced service. The subcontractor performing the service may not entrust it to another subcontractor.
  • The accompanying service shall be the subject of a contract or an agreement concluded between the household and the authorized accompanying person, which shall at least specify the services and their cost. Such a contract or agreement may specify the situations in which enhanced support is triggered and its additional cost. Any optional service performed in addition to the services must be mentioned in the contract or in the agreement. The contract or agreement shall state the services performed by subcontracting and the identity of the subcontractor(s)
  • The service shall be the subject of an accompanying report
  • The contract or agreement of engagement and the accompanying report shall be communicated to the National Housing Agency by the approved accompanying person or by the household, respectively, at the time of submission of the grant application and the balance.

Mandatory benefits

Support must include the following:

  • Assessment of housing and household conditions
  • Energy audit or presentation of an existing energy audit. In the overseas departments and territories, the energy audit is replaced by an energy assessment which meets one of the existing reference frameworks in those territories
  • Preparation and support for the realization of the project of works.

The work recommended as part of the accompanying measures must comply with the recommendations of the energy audit and make it possible, as a minimum, to improve the classification of the building with regard to its energy and environmental performance.

This accompaniment includes compulsory benefits following:

  1. A prior information phase comprising an initial visit
  2. An on-site diagnosis of the initial household situation
  3. The carrying out or use of an energy audit. In the Drom: titleContent, this audit shall be replaced by an energy assessment.
  4. An on-site housing condition review
  5. Advice and information on the following steps:
    • Preparation of the draft work
    • Completion of the work project
    • Getting started with the housing after work
  6. The production of an accompanying report submitted and countersigned by the household

1. Advance information phase

The advance information phase includes a initial visit which is composed of the following:

  • Information on the progress of the support until the conclusion of the contract or agreement, its cost
  • Information on the aid which may be granted to finance the work and accompanying measures, the conditions and procedures for granting aid. The accompanying person shall ensure that the household does not sign a quotation before:
    • Recommended for job quotation analysis
    • The submission of applications for public or private financial aid.
  • Household obligations as contracting authority, time limits and city planning authorizations for starting work.

2. Diagnosis of the initial situation of the household

The initial situation diagnosis on-site cleaning takes into account the 1è analysis carried out by information, advice and support desks, where available. This diagnosis consists of the following:

  • An assessment of the applicant's detailed economic situation, financing capacity and eligibility for different types of aid.
  • For small and very small households, advice on combating energy poverty.

3. Conduct or use of an energy audit (or energy assessment)

Energy Audit (Metropolitan France)

In metropolitan France, the energy renovation supervisor must to carry out or use a energy audit, satisfying the conditions relating to works and services for which the expenditure is eligible for the energy transition premium. This energy audit must be carried out by a qualified auditor.

The authorized accompanying person may have recourse to an existing audit carried out by a qualified auditor.

Energy assessment (metropolitan France)

In the Drom: titleContent, energy assessment replaces energy audit and includes recommendations for:

  • Installation of roofing, wall and bay solar shields
  • Improvement of the porosity of the facades in order to promote a natural outflow of the housing
  • Air velocity improvement by high aerodynamic and energy efficiency air mixers
  • Energy systems for air conditioning and domestic hot water, and VMC: titleContent when there is air conditioning
  • Heating and ventilation systems for the Hauts de La Réunion
  • Piloting solutions
  • Internal inputs, their power levels and how they are managed.

The energy assessment shall include at least 2 renovation scenarios, enabling an optimal energy performance level to be achieved in one or more stages for the dwelling in question, depending on the assessment of the energy savings deposits and the time of return on investment specific to each of the renovation gestures targeted.

For each stage of the work scenarios, the energy assessment shall specify the following:

  • State of play
  • Assessment of the annual final and primary energy consumption, greenhouse gas emissions of the building before and after work for each subsequent energy use: cooling, domestic hot water production, ventilation and lighting, and other internal inputs
  • Share of heating can be calculated for the highs of Reunion (area above 600 m altitude)
  • Estimated energy savings in kWh and then in euro compared to the modeled baseline, as well as the estimated detailed cost of the work per action and the financial support available
  • Quantitative (or qualitative where there is no methodology) assessment of thermal comfort through an assessment of envelope quality in terms of sun protection, air renewal rate and impact of internal inputs
  • For each type of work proposed, the minimum performance criteria for the equipment, materials or apparatus necessary for the companies to carry out the work
  • Existence of public aid for work to improve energy performance.

The energy assessment must be carried out by a professional approved by theAnah: titleContent.

4. On-site review of housing conditions

Review of housing conditions

L'housing condition review Onsite includes:

  • An assessment of the situation of indignity, indecency and housing peril. The authorized accompanying person shall use the simplified analysis grid made available by the National Housing Agency.
  • A simplified assessment of the household's loss of autonomy. The approved guide uses the simplified analysis grid made available by the National Housing Agency. In the event of a manifest situation of non-adaptation to a loss of autonomy noted, the authorized accompanying person shall refer the household to the competent actors.
Obvious situation of undignified habitat, indecency, non-adaptation to a loss of autonomy

In case of obvious situation of undignified housing, indecency, non-adaptation to a loss of autonomy identified as a result of the diagnoses made, or inadequacy of household resources and living conditions identified, the authorized accompanying person:

  • Reports on the situations encountered to the National Housing Agency and to information, advice and support desks
  • Delivers the enhanced services mentioned in Annex II of a decree available on Legifrance. The authorized accompanying person shall inform the National Agency for Housing and the counter of his/her wish to continue the enhanced services by himself/herself or by subcontracting, or of his/her wish to withdraw from the accompanying person at the same time as the alert.

Please note

The enhanced services may be carried out by authorized accompanying persons under the following conditions:

  • Either directly, provided that the conditions set by the regulations of the National Housing Agency to accompany households are met.
  • Or indirectly, by subcontracting under the conditions laid down in the regulations of the National Housing Agency.

5. Household advice and information

Preparation of the draft work

Under the preparation of the draft work, the accompanying person must provide:

  • The return of the energy audit (or energy assessment) and the provision of advice to the household on one of the work scenarios recommended in the audit
  • The provision by the accompanying person of a list of qualified professionals to carry out the relevant energy renovation works, accessible on the national information system, and located close to the place of the accommodation to which the accompanying person refers. It also provides advice on finding and obtaining work quotes
  • Advice on the analysis of work estimates with regard to their compatibility with the scenario of work selected and their price, as well as information on the possibility of project management, with assistance in finding a project manager and in concluding the contract of project management, at the request of the household.
  • Information on the compulsory city planning procedures for carrying out the work program, as well as on non-life insurance
  • The implementation of a project financing plan that identifies the various financial assistance that can be mobilized, including the following elements:
    • Aid from the National Housing Agency
    • Aid proposed by the operators of energy-saving certificates
    • Aid from local and regional authorities and their associations
    • Feed systems
    • Stay in charge.
      The financing plan shall be supplemented by information on the financing of the co-payments which shall include the zero rate loan, the zero rate eco-loan and the renovation advance loan. Where the household has not wished to provide detailed information on its economic situation, the implementation of the financing plan shall be carried out in accordance with the financial profile of the household and the aid measures it wishes to use.
  • Information and advice for submitting applications for public and private financial aid identified in the financing plan, in particular to the National Housing Agency, local and regional authorities and their groupings, and the actors of the energy savings certificate scheme.
    This advice includes support in obtaining the certificates of work required to benefit from the energy transition premium, as well as help in understanding online approaches and assistance in using digital platforms for the submission of aid or, failing that, in assembling paper files, until notification of the grant award.
Completion of the work project

Under the completion of the work project, the accompanying person must provide:

  • Information on the different phases of a renovation project until the reception of the works
  • Advice on the follow-up of a site, in particular on the coordination of the companies involved in order to ensure the proper implementation of the work project and the resolution of any technical difficulties found when laying the equipment by the companies of execution of the work
  • Assistance in the reception of work through the delivery of receipt cards
  • Updating the project's funding plan
  • Where the work carried out differs from the work recommended, the energy audit shall be updated on the basis of the work actually carried out.
Getting started with the housing after work

Under the housing ownership after work, the accompanying person must provide:

  • An on-site visit at the end of the service containing information on the correspondence of invoices and the work project with the estimate, the possible remedies in case of persistence of quality defects, an awareness on the proper use of the settled equipment and the renovated housing.
  • Information on the proper use of the dwelling, in particular indoor air quality, the use and maintenance of heating, ventilation and control equipment, summer comfort, eco-gestures and sobriety of uses
  • Assistance in the creation or updating of the housing information booklet.

6. Preparation of an accompanying report

The service is subject to a accompanying report remitted and countersigned by the household containing:

  • Date of initial and final site visits
  • Household identification information (name, address of the dwelling, number of the request for assistance for works)
  • Results of housing degradation and autonomy assessments for occupants, conducted using Simplified analytical grids made available by the National Housing Agency
  • The financing plan and the list of aid for the work requested
  • The energy audit carried out, or the existing energy audit. If it has been updated, the report shall explain the need to update the scenario originally foreseen.
  • The work project selected by the household
  • A list of the companies who carried out the work, together with their specifications, and the reference to their qualification or certification
  • The optional services provided
  • For reinforced accompaniments, the report assessing the deterioration or unwholesomeness, the full multi-criteria diagnosis and the date of the additional visits
  • The invoice for the accompanying service, if applicable
  • In the case of subcontracting, the nature of the services subcontracted and the identity of the subcontractor(s)
  • An attestation, on the basis of the invoices submitted, that the work carried out corresponds to the work projects.

The delivery of the end-of-service report to the household closes the support service.

Counseling may include optional benefits carried out at the request or with the consent of the household:

  • Airtightness test and ventilation control of the housing carried out at the end of the construction site
  • Loan of measuring tools (thermal camera, measurement of ventilation flow rates...) and explanations of their operation
  • One or more additional visits to the different stages of the support, in particular to understand the project of work and return the energy audit
  • Acting as financial agent for obtaining national, local aid or regulated loans if the accompanying person also has the status of intermediary in banking operations and payment services
  • An administrative agent's mission to assist the household in its steps
  • Advice for carrying out the work carried out in self-renovation accompanied, understood as proposals for scenarios where the work is not undertaken solely by one or more professionals proposed by the accompanying person, but with the involvement of owner-occupants or landlords. These households will then have to be accompanied by professionals (craftsmen, socio-technical work guides...) according to the appropriate legal and insurance regime.
  • A follow-up of post-work energy consumption after the construction site.

The Authorized operators shall submit an annual report to the National Housing Agency justifying in particular the compliance with the conditions of independence.

The activity report justifying compliance with the conditions of independence shall be transmitted before 31 March of each calendar year by the accompanying person approved atAnah: titleContent or its delegation within the jurisdiction of its registered office, and shall contain in particular the following:

  • Update on the number of persons devoted to the support mission on a full-time or part-time basis
  • Updating of the qualifications of the authorized accompanying person (training carried out and follow-up of the training plan declared at the time of application for approval, signs of qualities obtained)
  • Forecast activity for the coming year, including the estimated share of subcontracted accompaniments and the nature of the subcontracted benefits
  • Full list of the accompanying measures carried out for the previous year, identifying the accompanying measures including a subcontracting component and specifying the identity of the subcontractors concerned. The list shall specify the ongoing and abandoned accompanying measures
  • Updated capital structure
  • Possible changes in the structure, organizational structure, recruitment, etc.

Framework for controls

L'Anah: titleContent can to control or have checked, on the basis of documents and on the spot, in accordance with a multiannual program which it shall draw up, any holder of an approval. The purpose of these checks is to verify the existence and quality of the accompanying measures carried out throughout the service and the operator's continued compliance with the rules and principles to which the grant of approval was subject.

They shall be made available of the National Housing Agency any document drawn up during the accompanying service for a period of 5 years.

The authorized accompanying person is prior warning the carrying out of an on-the-spot check on him and gives his consent. Failure to reply within 2 months or refusal to reply shall result in the application of the procedure for withdrawal of approval. Obstruction of the on-the-spot and on-the-spot checks constitutes a reason for non-compliance with the undertakings relating to the grant of approval, leading to its definitive withdrawal.

At the end of the inspection, and in the event of non-compliance with the commitments entered into, a report describing the findings shall be drawn up and signed by the official who carried out the inspection, containing corrective measures. These may include guidelines to better support efficient renovations. The holder of the authorization may then submit his written observations within one month.

Quality control of accompaniments

Controls include a monitoring of the implementation of support services, known as the “quality control of accompaniments”, carried out by theAnah: titleContent or its local delegation.

This check shall be carried out at the time when the commitment or the grant balance for works is requested. The controller service shall examine:

  • The contract or agreement, which must be complete and in conformity
  • The accompanying report when carrying out a balance check
  • This check may also be carried out on the spot in the accommodation which is the subject of the accompanying mission. The authorized accompanying person and the accompanied household shall make available to the inspector all the documents relating to the accompanying services carried out
  • The documents submitted in connection with applications for aid for works.

Control of the structure receiving approval

The controls may also include a control of the structure receiving approval by theAnah: titleContent or its local delegation, to ensure that:

  • Validity of the conditions of approval
  • Validity of the documents submitted during the examination of the application for approval
  • Consistency and veracity of annual reports and commitments undertaken by the approved structure.

Checks on the approved structure may be carried out on the basis of documents or on the spot:

  • On the basis of the examination of the documents supplied when the application for approval was lodged and of the activity report. The National Housing Agency may request any evidence from the holder of the approval by any means.
  • On the spot, at the registered office and in the premises of the authorized accompanying person. All the documents necessary for carrying out the check, in particular the documents forwarded when the application for approval was lodged, the activity reports and the documents justifying compliance with the conditions essential for the exercise of the profession of accompanying person, shall be made available to the inspector.

Amendment of the authorization

The authorized accompanying person must inform theAnah: titleContent or its local delegation of any significant changes concerning his situation, in particular:

  • Change of address
  • Change of name
  • Change of staff carrying out the accompanying activities
  • Change in the structure of its capital
  • Loss and acquisition of new qualifications
  • Change in geographical scope of intervention

In the event of a change which would call into question the validity of the criteria required to act as an energy renovation attendant, a new authorization procedure shall be carried out. Any request to update the declared area of intervention must be reported to the National Housing Agency or its local delegation, which carries out a new authorization instruction.

These notifications are made using the teleprocedure services set up by the National Housing Agency.

Renewal of approval

The applicant for approval shall use the approved forms made available by theAnah: titleContent for the preparation of the initial application and renewal files:

By way of derogation, certain documents in the renewal application may not be required for the following natural and legal persons:

  • Structure that has contracted with a local authority or its association to provide information, advice and support services
  • Operator of the National Agency for Registered Housing
  • Architect
  • Structure contributing to the implementation of a planned habitat improvement operation or a program of general interest for habitat improvement, provided that this operation is in the course of a valid agreement with a territorial authority or a group of territorial authorities.

In the event of an incomplete file, the National Housing Agency shall send the person concerned a request for additional documents. The time-limit for examining approval shall be suspended until the requested additions are received. The application for authorization may be rejected if a file remains incomplete after an initial request for supplements.

Approval or renewal shall be granted by express decision of the National Housing Agency for a maximum duration of 5 years renewable, within three months of the date of submission of the file. The Agency's silence at the end of this period shall be deemed to constitute an implied decision rejecting the application.

Approval is valid:

  • On the national perimeter, for natural and legal persons
  • Within the territorial jurisdiction of the territorial collectivity or grouping of territorial collectivities, for businesses of third party financing

After studying the supporting documents, in the event of a legitimate and persistent doubt as to the capacity or independence of the operator, or if the documents transmitted do not meet the requirements laid down by the applicable regulations, the National Housing Agency may refuse to renew the authorization.

Where the holder of the approval no longer meets the conditions for the issue of the approval, shall inform theAnah: titleContent.

Approval may be withdrawn at any time by theAnah: titleContent, where the holder fails to comply with his obligations or no longer fulfills the conditions which enabled him to be granted an approval. The withdrawal shall be made by the National Housing Agency after it has given the holder of the approval the opportunity to submit his observations within a period of between 15 days and a maximum of one month fixed by the Agency.

Withdrawal of approval during the service does not affect the validity of the support for the award of energy renovation premiums (for the customer).

Approval may be suspended for a maximum of 3 months or permanently withdrawn, in particular for the following reasons:

  • Obstruction of controls or a request for control which has not been answered
  • Following the completion of one of the checks and in the absence of corrective action within the period of one month
  • Outsourcing of accompanying tasks outside authorized cases
  • Communication of false information or documents in support of the application for authorization
  • The execution of a work or the absence of neutrality with respect to a work execution company or recommended technological solutions
  • Partial, inadequate implementation, or failure to implement support services
  • Lack of awareness of consumer protection provisions
  • In the event of a significant change in the situation of the authorized operator which would jeopardize the fulfillment of the approval criteria
  • For any other reason of non-compliance with the obligations related to the tasks of the energy renovation attendant.

The decision to suspend or withdraw permanently shall be notified to the operator by registered letter with acknowledgement of receipt. The suspension or permanent withdrawal of the approval during the course of the service does not call into question the validity of the support for the award of grants for energy renovation.
