Mandatory marking of single-use products containing plastic

Single-use products containing plastic must have mandatory marking. This concerns, in particular, sanitary napkins, the tampons, the pre-soaked wipes, the tobacco products with filters, the filters marketed for use in combination with tobacco products and drinking cups and glasses. We're explaining the regulations.

The following single-use products, consisting of all or part of plastic, or their packaging must bear the mandatory marking:

  • Sanitary pads, tampons and tampon applicators
  • Pre-soaked wipes for personal and household use
  • Tobacco products with filters (cigarettes, certain cigarillos, etc.) and filters marketed for use in combination with tobacco products
  • Cups and drinks glasses, with the exception of those which contain only trace amounts of plastic.

This marking, used in a harmonized manner throughout the European Union, loose users of the following:

  • Plastic in these products
  • Poor sorting gestures to avoid (do not throw them out in the open, in the toilet)
  • Negative environmental impact of these products in case of missorting or uncontrolled deposition.

The compulsory marking must be affixed in accordance with the specifications set out in the Annexes to the following European Regulation:

The specifications are set out in the following annexes:

  • Annex I for sanitary napkins, tampons and tampon applicators
  • Annex II for pre-soaked wipes for personal and household use
  • Annex III for tobacco products with filters (cigarettes, certain cigarillos, etc.) and filters marketed for use in combination with tobacco products
  • Annex IV for beverage cups and glasses, with the exception of those which contain only trace amounts of plastic.

The Regulation provides in particular for the following:

  • Model of the marking and associated endorsement
  • Marking Location
  • Size of the marking

The absence of marking or the presence of marking which does not comply with all the rules laid down in the European rules is punished by the penalty provided for contraventions of 3e class.

This corresponds to a fine of €450 (natural persons) or €2,250 (legal persons).
