Plastic products prohibited

The use of certain plastics is limited or prohibited, in order to limit their impact on the environment. Many products are concerned: packaging, single-use plastic bags, disposable tableware, wadding sticks, tea bags, cosmetics, etc.

Bags concerned

Some single-use plastic bags are prohibited.

These are single-use plastic bags for packaging goods at the point of sale with all of the following characteristics:

  • With or without handles
  • Plastic compounds
  • Supplied to consumers at points of sale for goods or products
  • Less than 50 microns thick.

This prohibition applies to their:

  • Manufacturing with a view to distribution in France
  • Sale
  • Don free of charge.

Please note

The bags compostable in domestic composting and consisting of at least 60% of materials biosourced are authorized, including single-use plastic bags for the packaging of goods at the point of sale.

One compostable bag of domestic composting and consisting, in whole or in part, of materials biosourced is a bag that has all of the following characteristics:

  • Plastic compound to 60% at least of biological origin (excluding materials incorporated in geological or fossilized formations)
  • Thick less than 15 microns
  • Meets the requirements of the approved French standard for specifications for plastics suitable for home composting (NF T51-800) or has equivalent guarantees.

Penalty foreseen

Failure to comply with the prohibition on the manufacture, sale or donation of single-use plastic bags shall be punishable by fine of a maximum of €3,000 (natural person) or €15,000 (legal person).

Disposable tableware

The single-use plastic products following are prohibited :

  • Disposable plastic cups and glasses with a plastic content greater than 8%
  • Cups and glasses made wholly or partly of expanded polystyrene, including their closure means and lids
  • Disposable glass lids
  • Disposable plates made wholly or partly of plastic, including those with plastic film
  • Straws (except for those intended for medical use)
  • Steak picks
  • Cutlery: forks, knives, spoons, chopsticks, etc.
  • Mixer sticks for drinks
  • Expanded polystyrene food containers for on-site or nomadic consumption
  • Expanded polystyrene beverage containers, including their caps and lids
  • Expanded polystyrene bottles for drinks.

This applies to the sale and at donation free of charge of these products.

The ban also applies to all plastic products that have durability (single use), strength, and strength performance comparable to single use products.

Please note

Cups and glasses and disposable kitchen plates for the table must contain at least 50% of materials biosourced.

Other plastic products

The following plastic products are also prohibited :

  • Support rods for balloons and their mechanisms, with the exception of rods and mechanisms intended for industrial or professional uses and applications and not intended for distribution to consumers.
  • Coated sticks for domestic use (cotton swabs) with a plastic rod, except those for medical use
  • Confetti
  • Products, packaging or bags manufactured, in whole or in part, from oxodegradable plastic are prohibited
  • Non-biodegradable plastic tea and herbal tea bags
  • Plastic toys as part of menus for children.

This applies to the sale and at donation free of charge of these products.

The ban also applies to all plastic products that have durability, strength, and strength performance comparable to that of single-use products.

Penalty foreseen

In the event of non-compliance with the prohibition on the sale and free donation of single-use plastic products, a penalty is planned.

Establishments that can serve 20 or more people simultaneously must serve meals and beverages consumed within the establishment in cups, including their closures and lids, plates and containers reusable, with reusable covers.

Home catering services that offer a subscription to prepared meal services that are delivered at least 4 times a week must use cups, cutlery, plates and containers reusable and which are the subject of collection.

Warning  

Serving food and beverages in single-use containers for company subject to the obligation to serve in reusable containers is punishable by a fine of €1,500 (natural person) or €7,500 (legal person).

Since 1er In January 2025, catering services offering take-away services are required to offer consumers the option of being served in a reusable container or made of recyclable materials.

He is prohibited to distribute free plastic bottles containing beverages in public institutions (LES) and in premises for professional use.

Free distribution is permitted exceptionally in each of the following cases:

  • In establishments not served by a drinking water network
  • When the free distribution of plastic bottles meets a public health imperative
  • When a restriction of water intended for human consumption for food uses is imposed by the competent administrative authority (the prefecture).

Please note

It is forbidden to impose the supply or use of single-use plastic bottles for festive, cultural or sporting events in contracts.

The contractual clauses that provide for this should not be applied, except in cases where the substitution of these bottles by reusable products is impossible (for example if this goes against a health obligation).

Labeling directly on fruits or vegetables is allowed only for labels compostable in domestic composting and consisting partly or wholly of materials biosourced.

Labeling directly on fruits or vegetables is prohibited for all other labels, including non-compostable plastic.

Failure to comply with this prohibition shall be punished by fine of €450 (natural person) or €2,250 (legal person).

He is prohibited to sell or give for free any substance in the state of microplastic, as such or as a mixture, intentionally present in a concentration equal to or greater than 0.01%.

Natural microplastics that have not been chemically modified and biodegradable microplastics are not affected.

This prohibition applies systematically rinsed cosmetic products for exfoliation or cleaning purposes containing solid plastic particles. The prohibition does not apply to naturally occurring particles that are not likely to remain in the environment.

This prohibition does not apply substances and mixtures which:

  • Are used on an industrial site
  • Are used in the manufacture of medicinal products for human or veterinary use
  • Are strictly confined by technical means throughout their life cycle to prevent their release into the environment and which are contained in waste intended to be incinerated or disposed of as hazardous waste
  • Have permanently modified physical properties, to the point that the polymers no longer correspond to the definition of microplastic
  • Are permanently incorporated into a solid matrix during their use.

FYI  

Companies that produce, import or use a substance or mixture containing microplastics must include a mandatory statement on their products. This one shows all the instructions for use to avoid the release of microplastics into the environment, including at the end of the life of the products.

Instructions must be visible, legible and indelible.

New domestic or professional washing machines must be equipped with a plastic microfiber filter or any other internal or external machine solution to retain microplastics.

He is forbidden to pack in plastic :

  • The press publications (newspapers, magazines, etc.)
  • The advertisingaddressed or unaddressed (in the form of booklets, leaflets, cartons, etc.).
