Definition
A dental surgeon is a health care practitioner who practicesodontology, i.e. the study of the dental organ, the maxilla and the surrounding tissues. Thus, it ensures the prevention, diagnosis and treatment of abnormalities related to these parts of the body.
They may also do operations requiring anesthesiaAs in the case of the extraction of wisdom teeth, for example.
Most often, the dental surgeon deals with the cleaning of the teeth of his patients, treats caries, prepares the fitting of prostheses by making moldings, and shares his advice on oral hygiene.
Warning
Dental surgery and stomatology should not be confused, they are 2 separate professions. Stomatology is a specialty of medicine, the stomatologist is listed in the table of the Order of Physicians.
Access
The profession of dental surgeon is regulated. You have to fill out conditions on nationality, training/qualification and registration (or declaration) with the Council of the College of Dental Surgeons.
If these conditions are not filled, the practice of dentistry is illegal. This is a criminal offense punishable by 2 years imprisonment and €30,000 of fine.
To practice the profession of doctor, you must have one of the following nationalities :
- French nationality
- Nationality of a Member State of the European Union (EU) or party to the Agreement on the European Economic Area (EEA)
- Andorran citizenship
- Moroccan or Tunisian nationality
However, the person who does not have one of these nationalities may still practice the profession of dental surgeon when any of the following :
- She holds a French State Diploma in Dental Surgery
- She has the French State Diploma of Dental Surgeon
- It has a exercise authorization (EA) issued by the National Commission for Authorization to Practice.

French
In order to practice as a dental surgeon, the French national must hold one of the following diplomas :
- French State Diploma in Dental Surgery
- French State Diploma of Dental Surgeon.
If the French national has obtained his diploma in a Member State of theEU or theEEE, he may benefit from automatic recognition evidence of formal qualifications, in the following 3 cases :
- The evidence of formal qualifications appears on the list of recognized european diplomas. This list has been established by European legislation and can be consulted at annexes 5.3.2 and 5.3.3 of the Directive 2005/36/EC.
- The evidence of formal qualifications not shown in the list (e.g. diploma has changed name). On the other hand, the national has certificate of conformity issued by the competent authorities of the State of origin, certifying that his diploma is assimilated to the diplomas appearing on the list.
- The evidence of formal qualifications not shown in the list. On the other hand, the national has certificate of acquired rights issued by the competent authorities of the State of origin, certifying that he has pursued the activity of a dental practitioner during 3 consecutive years in the last five years.

In addition, a French national residing and practicing abroad may working in France on a temporary and occasional basis. We talk about “ freedom to provide services (LPS) ”.

National of a Member State of the European Union or the European Economic Area
A dental surgeon who is a citizen of a Member State of the European Union (EU) or the European Economic Area (EEA) a 2 possibilities :
- Or he settles in France for an exercise permanent.
- Either he exercises temporarily and occasionally its activity in France. It's called “freedom to provide services”.
Establishment in France (permanent exercise)
In order to settle in France, a European national must demonstrate the following qualifications:
- One valid evidence of formal qualifications. The European national may benefit from a automatic recognition procedure of his degree. If he does not meet the conditions for such a procedure, he must then carry out a application for authorization to practice.
- One sufficient knowledge French language.
Automatic recognition procedure
Where the European national holds a diploma enabling him to practice in his country, he may benefit from the automatic recognition evidence of formal qualifications, in the following 3 cases :
- The evidence of formal qualifications appears on the list of recognized european diplomas. This list has been established by European legislation and can be consulted at annexes 5.3.2 and 5.3.3 of the Directive 2005/36/EC.

The departmental council of the College of Dental Surgeons verify the regularity of the diplomas, diplomas, certificates and attestations. Then it decides whether or not to grant automatic recognition.
This automatic recognition gives direct access to the profession in France, after registration with the Departmental Council of the College of Dental Surgeons of the place of practice.
Warning
Apart from these three cases, the European national cannot benefit the automatic recognition of his professional qualifications.
Non-conforming diploma: application for authorization to practice (AE)
Where the diploma of the European Union (EU) or European Economic Area (EEA) national does not benefit from the automatic recognition scheme, he must apply for a exercise authorization (EA).
The national must meet certain conditions to apply for a license to practice (EA). These conditions vary depending on the country in which the diploma was obtained:
- If the diploma was obtained in an EU or EEA State: the national can apply for a license to practice without any special conditions.
- If the diploma does not not obtained in an EU or EEA State, but is recognized by one of those States : the national must provide proof of 3 years of fiscal year as a dental practitioner, in the country which recognizes this diploma.
- If the diploma does not not obtained in an EU or EEA State: the national must first register for the competition knowledge verification tests (KVTs). At the end of this competition, the national shall enter a Skills Building Pathway (PCC) for one year in a health institution in which he is assigned, under the status of associate practitioner.

Once all the conditions have been met, an application for a license to practice (EA) must be dematerialised on the website of the National Center for the Management of Hospital Practitioners and Management Staff of the Hospital Public Service:

The application for authorization to practice is considered by the National Commission for the Authorization of Practice (CNAE). This one takes one of the following decisions :
- Direct favorable opinion : the national receives an individual notification of authorization to practice by post which will allow an entry in the table of the College of Dental Surgeons.
- Unfavorable opinion (= compensatory measures) : if the examination of professional qualifications and experience reveals significant differences with the qualifications required for access to the profession in France, the Commission may require the implementation of a compensatory measure (an adaptation period and/or an aptitude test). The case will then be re-examined by the Commission.
Freedom to provide services (temporary exercise)
A dental practitioner may working in France on a temporary and occasional basis, if it complies with all of the following conditions:
- Be a national of a Member State of theEU (EU) or party to the agreement onEuropean Economic Area (EEA)
- Holder:
- or a diploma obtained in an EU Member State or party to the EEA Agreement
- or a diploma issued by a third country but recognized in an EU Member State or party to the EEA Agreement
- Be established and practice dentistry in an EU Member State or party to the EEA Agreement other than France.
The temporary and occasional nature of the provision of services is assessed on a case by case basis, in particular as a function of its duration, frequency, periodicity and continuity.
In addition, the applicant national must justify by all means her French language skills. An interview with the departmental council of the future place of provision of services or with the national council may be envisaged.
The authorization is sent by post to the applicant (the absence of a reply from the National Council of the Order after the deadlines set constitutes an implicit authorization). Therefore, the applicant is included in the specific list of practitioners for the freedom to provide services. He receives a receipt including his registration number on the list, as well as the list of primary health insurance funds and that of the councils of the Order.
The authorization is valid for 1 year for a total exercise period (one or more times) of 3 to 4 months maximum. It can be renewed annually.

In the event of a refusal, the applicant shall be informed by letter explaining the reasons for the refusal. He may challenge the refusal by a appeal to the administrative court competent.
Third-country national
A third-country national, i.e. a non-member of the European Union (EU) or the European Economic Area (EEA), must apply for a exercise authorization (EA) to practice in France.
The procedure to follow varies according to the country where the diploma was obtained :
Diploma obtained in an EU or EEA State
If the diploma was obtained in an EU or EEA State, the applicant may apply for a license to practice, without special conditions.

Apply for a license to practice (EA) to practice as a dental surgeon
The National Commission for the Authorization to Practice (CNAE) may take one of the following decisions:
- Direct Favorable Opinion : the applicant receives an individual notification of authorization to practice by post which will allow an entry in the table of the College of Dental Surgeons.
- Stay of proceedings : the commission cannot take a decision because of a lack of information. The case will be re-examined by the CNAE.
- Unfavorable Opinion : if the examination of professional qualifications and experience reveals significant differences with the qualifications required for access to the profession in France, the Commission may require the implementation of a compensatory measure (a pathway for consolidating skills). The case will then be re-examined by the Commission.
To be able to practice in France, a dental surgeon is obligatory registered:
- Either on the order chart held by the departmental council (for a regular and/or sustainable exercise in France)
- Either on the list of practitioners for the freedom to provide services maintained by the National Council of the Order (for a temporary and/or occasional exercise in France). This route is open only to nationals of EU Member StatesEU (EU) or party to the agreement onEuropean Economic Area (EEA).
General case
To practice permanently in France, the practitioner must request his registration on the board from the President of the departmental council of the Order the place where he intends to practice.
Find a departmental or regional council of the College of Dental Surgeons
This request must be made by registered letter with a request for a notice of receipt or delivery against receipt, accompanied by a file containing subsequent documents :
- Registration form, provided by the departmental council
- Photocopy of a valid ID. If the identity document provided does not attest to this, a certificate of nationality issued by a competent authority must also be provided.
- Copy of the training certificate. In addition to the diploma, a certificate of conformity, a certificate of acquired rights or a license to practice may also be required as appropriate.
- Declaration on the honor of the person certifying that no proceedings capable of giving rise to a conviction or penalty which may have an effect on the inclusion in the table are in progress against him
- Certificate of cancelation, registration or registration issued by the authority with which the person is still registered or registered OR a declaration on honor certifying that he has never been registered or registered, OR, failing this, a certificate of registration or registration in a Member State of the European Union (EU) or party to the Agreement on the European Economic Area (EEA).
- In the case of nationals of a foreigner State, an extract from the criminal record and certificate of professional status, less than three months old, issued by a competent authority of the State of origin or the State from which the foreign national comes
- All the elements necessary to establish the adequate command of the French language necessary for the exercise of the profession

Any document written in a foreign language must be accompanied by a translation into French made by a sworn translator.
The departmental council acknowledges receipt of the request in a 1-month period from its receipt and, where appropriate, indicate to the applicant the missing documents and information.
Then, the departmental council has a three-month period, as from the receipt of the complete file, to take a decision on the application. This period may be extended by 2 months where an expert opinion is necessary to give rise to serious doubt as to professional competence or psychological or physical fitness.

In the event of a decision to refusal, the applicant shall be invited by registered letter at least 15 days in advance, to present its explanations before the departmental council of the order. This refusal can be challenged within 30 days, before the Regional Council of the competent order which will decide within 2 months.
From the time of registration with the Order, the practitioner receives a certificate of registration in the Order's register (to be presented when registering with the Health Insurance). He also gets a RPPS number (Shared Health Professional Directory) and its healthcare professional card (HPC).
Furthermore, the practitioner must to pay the ordinary contribution required during 1er quarter of calendar year in progress. Payment may be made by check or online on the website of the National Council of the College of Dental Surgeons.
Freedom to provide services (temporary exercise)
A dental practitioner may working in France on a temporary and occasional basis, if it complies with all of the following conditions:
- Be a national of a Member State of theEuropean Union (EU) or party to the agreement onEuropean Economic Area (EEA)
- Holder:
- or a diploma obtained in an EU Member State or party to the EEA Agreement
- or a diploma issued by a third country but recognized in an EU Member State or party to the EEA Agreement.
- Be established and practice dentistry in an EU Member State or party to the EEA Agreement other than France.
- Before the first provision of services, send a prior declaration directly to the National Council of the Order. The declaration shall include the subsequent documents :
- Declaration Form
- Identity document stipulating nationality
- Diploma (possibly a certificate of acquired rights less than 3 months old or any proof of exercise for 3 years)
- Certificate of current employment status less than 3 months old
- Certificate of registration in the Member State of the European Union or party to the Agreement on the European Economic Area
- Professional civil liability (CPR) by completing the part reserved for it in the declaration form if it is a French CPR
or by providing the contract if it is a SPC signed in the European country of origin in order to verify the extent of the guarantees for the exercise on French territory.

The prior declaration accompanied by the supporting documents must be sent to the National Council of the Order, by any means (simple letter, recommended, fax, email...). The National Council of the Order has 1 month to review the file.

Exercise
Exercising as a dental surgeon involves doing steps and compliance with certain obligations.
The liberal activity may be exercised in a dwelling room. This may be the dentist's primary residence or an independent facility. He must first verify that the residential lease and the ownership regulation do not prohibit the exercise of an activity.
The activity of a dental surgeon involves receiving patients. Thus, it is also necessary to obtain assignment change authorization office with the mayor in the cities of more than 200,000 inhabitants, in Paris, as well as in the municipalities of the little crown of Paris.
The liberal activity may also be exercised in office space :
- Business premises or mixed-use premises (i.e. residential and business premises)

In order to combat medical desertification, there are several installation aids for dental surgeons who wish to practice in understaffed areas.
Once registered on the College's chart, the dental surgeon must declare and register his/her professional activity with the Health Insurance.
To do so, it must first make an appointment, by telephone, with the Primary health insurance fund (CPAM) of his place of practice.
Dental surgeon, liberal installation: make an appointment with CPAM
On the day of his interview at the CPAM, the dental surgeon must present the subsequent documents :
- Certificate of registration on the Order's board
- Vital Card
- Bank Identity Statement (BIR)
- Notification of declaration of the radiological installation, if necessary.
An advisor checks the documents and instructs the installation folder for registration in the Health Insurance repository. The practitioner receives care sheets pre-identified in his name (according to the printing facilities available on site).

He is proposed to join the national convention of dental surgeons. In the event of membership, the practitioner is affiliated to the health insurance scheme for practitioners and medical auxiliaries (PAMC). It therefore benefits from the next protection :
- Reimbursement of health costs in case of sickness or maternity, according to the same conditions and rates of reimbursement as any other insured
- Payment of specific allowances or allowances in the case of maternity leave, paternity/childcare leave, adoption leave or leave from work due to medical difficulties linked to pregnancy
- Death capital.
The dental surgeon may carry out his professional activity under one of the following legal forms :
- Individual business in the following order: the dental surgeon shall act in his own name and shall declare his turnover in non-commercial profits (NBC) and is subject to income tax (IR).
- Business: the dental surgeon exercises alone or with other partners. Creating an exercise business optimizes the tax burden by distributing revenue among partners. Options can reduce income tax (IR) or business tax (SI) and payroll taxes.
If he wishes to practice in businessHowever, the dental surgeon must choose one of the following forms :
- SELARL (business of private practice with limited liability) or SELARLU (business of one-person private limited liability)
- SELAS (simplified liberal share business) or SELASU (single-person simplified liberal share business)
- SELAFA (Anonymous Liberal business)
- SELCA (stock-sponsored liberal exercise business)
- PCS (professional civil business), it allows several professionals to practice their profession together
- SCM (civil business of means), it allows the pooling of means (personnel, material) with colleagues.
The business is constituted as soon as registration in the order table. The request for registration of the business is presented collectively by the partners and addressed to the departmental council of the order of the seat of the business.
Please note
It is forbidden for a dental surgeon to give management or to accept the management of a dental practice, unless authorized by the National Council of the Order in exceptional cases (e.g. illness, departure abroad).
The dental surgeon must perform his declaration of commencement of activity on the website of the company formalities office, within 8 days of commencement of activity (after having completed the administrative formalities with the Health Insurance):
This declaration allows you toinform all organizations concerned by the launch of the activity (Insee: titleContentsocial organizations, Urssaf: titleContent, Center for Public Finance...).
Insee shall award a Siret number. This is a unique national identification number that identifies the establishment. It is composed of Siren (first 9 digits) which identifies the company and the Nic (last 5 digits) which is modified in particular when the address of the establishment is changed.
When registering the company, Insee also assigns the dentist a EPA code designating its principal activity. For dental practice, the APE code is 86,23Z.
All liberal dentists are required to subscribe to a professional indemnity insurance (CPR). This insurance must be taken out even before exercising, a certificate of subscription may be required at the time of registration with the Order.
PKI insurance helps cover damage to a patient or a third party in the course of professional activity, for example during dental treatment. It provides support in finding an amicable solution, covering legal and procedural costs, and compensating for damage.
Warning
Non-subscription of a PII insurance shall be punishable by fine of €45,000 and a prohibition from practicing against individual contractors and a fine of €225,000 against the businesses.
Membership in the Independent Pension Fund for Dental Surgeons and Midwives (CARCDSF) is obligatory for any dental surgeon registered with the College and practicing as a liberal (even part-time), including if he is otherwise employed.
To join the CARDCSF, the practitioner must complete and transmit the membership form. Affiliation shall take effect to 1er day of the calendar quarter following the start of business (e.g. for a start of activity on 2 february, membership will take effect on 1er April).

The new members are exempt from the proportional contribution under the first 2 calendar years of their exercise and may, on written request, also benefit from a waiver of the flat-rate contribution. The application must reach the CARCDSF within 60 days that follow the call for assessment.
The CARCDSF provides a simulator allowing the practitioner to calculate the amount of his contributions.
From the beginning of his activity, the dental surgeon pays social security contributions to theUrssaf: titleContent. They are calculated on the basis of realized income.
These contributions are must be paid online in one of the following ways:
- Either every month. The monthly payment is made on the 5th of each month (or the 20th on option) by direct debit.
- Either every quarter. The quarterly payment is made by direct debit, by electronic payment or by credit card. Contributions are payable for February 5, May 5, August 5, and November 5.
The dental surgeon cannot benefit from the micro-social scheme.

The Code of Ethics for Dental Surgeons sets out the main principles that all dental surgeons must respect in the exercise of their profession. These principles aim to ensure compliance with ethical and professional rules, thus ensuring the protection and safety of patients, as well as the quality of care provided.
These principles cover ethical, technical, interpersonal and administrative aspects, including:
- Respect for the dignity of the person : the dentist must respect the dignity and rights of patients without discrimination.
- Professional secrecy : the dental surgeon is bound by professional secrecy, covering all information relating to patients, whether medical or personal.
- Professional independence : The decisions of the dental surgeon should be made independently, avoiding any external influence, whether commercial or otherwise.
- Competence and continuing education : Dental surgeons should maintain and improve their professional knowledge and skills through continuous training.
- Quality of care : care must be conscientious, attentive and based on the evidence of science. The dental surgeon must exercise with caution and diligence.
- Relationship with patients : the dental surgeon must establish a relationship of trust with his patients, by informing them in a clear and comprehensible way about their state of health and the treatments offered.
- Confraternity : relations with colleagues must be characterized by respect and courtesy. The dental surgeon must avoid unfair competition.
- Advertising and public information : personal advertising is strictly regulated. All information disseminated must be fair and honest, not intended to mislead the public.
- Unlawful pursuit of the profession : the dental surgeon must take care not to assist or encourage the illegal practice of the profession by unauthorized persons.
- Professional acts and documents : the writing and keeping of professional documents (patient records, prescriptions, etc.) must be carried out with rigor and in accordance with established rules.
Infringements of these provisions fall within the disciplinary jurisdiction of the order.

The cumulation of the practice of dentistry with another activity must respect the principles of professional dignity and independence vis-à-vis the other players in the health sector and its colleagues.
Thus, it is prohibited for a dental surgeon to engage in a second activity in order to increase his professional reputation or the clientele of his practice. For example, he cannot use an elected, political or union mandate or an administrative function to increase his clientele.
Likewise, the dental surgeon must not exercise an activity exposing him to self-compounding that is to say, to a commercial conflict of interest likely to guide its judgment to the detriment of patients and third parties. Therefore, a dental surgeon cannot practice the following professions:
- Doctor, pharmacist, optician, medical assistant, etc.
- Manufacturer or vendor of medical devices
- An ambulance attendant or an ambulance business manager
- Owner or manager of a hotel for patients, a fitness room, a treatment facility, a center for advice on aesthetics, hygiene or dietetics, a fitness center, a spa, a massage room, a beauty institute, etc.
Every practicing dental surgeon is required to participate in a continuous professional development (CPD). This program includes assessing professional practices, developing skills, and improving the quality and safety of care.
Every 3 years, the practitioner should do a Continuing education (CF) and a Professional Practice Assessment (PPE). It is also possible to participate in an integrated program that combines these 2 types of actions into one training. L'ANDCP: titleContent provides a tool for find DPC action.

All the actions carried out by the practitioner as part of his continuous professional development are traced in a traceability document certifying compliance with that obligation.

The dental office must specify whether or not it complies with the fees set out in the National Dental Surgeon Convention. It must display one of the following :
- “ Your healthcare professional charges fees in line with social security rates. These rates may not be exceeded, except in the event of an exceptional requirement on your part concerning the time or place of the acts performed, or in the event of non-compliance with the treatment plan. ”
- “ Your healthcare provider is not covered by social security. As a result, the benefits that will be issued to you will only be reimbursed very slightly.”
- “ Your healthcare professional freely determines his/her fees, which may therefore be higher than those set by the convention linking him/her to social security. ”
It shall also display, as clearly as possible, the fees charged and the social security reimbursement basis for:
- A usual consultation
- The 5 most widely practiced conservative, surgical and preventive care services (minimum)
- The 5 most commonly used prosthetic and dento-facial orthopedic treatments (minima).
These indications must be visible to all and directly legible, whether in the waiting room or at the place where the fees are collected.
Dental surgeons having member of an Authorized Management Association (AGA) should also display this membership as: “ Member of an association approved by the tax authorities accepting payment of fees by checks drawn up in his name ”. This statement may, moreover, be included on the prescriptions and invoices of the practitioner.
