Occupation of the Public Domain by Trade (AOT)

You are a merchant and you want occupy part of the public space (sidewalk, squares) for your business? You must request authorisation (in town hall or prefecture). This is a AOT: titleContent. There are 3 types of permissions: parking permit (open terrace, food lorry, display, fairground), road licence (closed terrace, kiosk) and right of way (market, market). You must pay a royalty.

Open terrace, shelf, food lorry

You are concerned if you are among the following merchants:

  • Restaurant, bar or café with an open terrace with tables and movable chairs, possibly delimited by window boxes or removable screens. It can also be a terrace located on the edge of the pavement, allowing pedestrians to walk between the front and the tables.
  • Trader with a product display or mobile equipment (e.g. ice tray, cooking appliance) placed against the front of the shop or on the edge of the sidewalk
  • Food lorry, lorry or food lorry or take-away drinks
  • Drill for the installation of rides or barges

The terrace is only allowed for bars, cafés and restaurants.

The communal rules may sometimes allow the terraces only to the owners of restaurant, bar or café commercial funds, and not to the landlords.

theAOT: titleContent is not necessary for a counter overlooking the street (snack, sandwich shop, bakery), whose customers stay on the pavement while making a purchase.

To occupy part of the public space in front of your shop or restaurant, you must follow the following rules:

  • Do not create any obstacles to pedestrian traffic, for persons with reduced mobility or visually impaired and for emergency services
  • Allow access to neighbouring buildings and preserve the tranquillity of the residents
  • Respect opening dates and times set in the authorisation
  • Respect hygiene rules for foodstuffs (cold chain, protection of prepared dishes)

These rules are often written in a charter of commercial occupation of the public domain, published by the commune.

You can usually visit it on the website of your city or prefecture (or on site).

You must include at least the following documents with your application:

  • Copy Extract K or Kbis (certificate of entry in the commercial register RCS: titleContent or the register of trades)
  • For cafés, bars and restaurants: copy of licence on behalf of owner or operator of trade fund
  • Copy of commercial lease or title
  • Insurance certificate for the occupation of public space
  • Description of the terrace or the display and the materials used, with a plan specifying the location of the device on the sidewalk and its size
  • Bank Identity Statement (Rib)

What is the response time?

The processing of the application is between 2 weeks and 1 month depending on the municipality.

If no reply is received within 2 months, the application is considered refused.

Warning  

an authorisation issued at local events by a holiday committee or an association has no legal value and may be cancelled.

How do I get permission?

A municipal or prefectural decree is published. It is posted at the town hall or prefecture for a minimum of 2 months.

It personal : it cannot be transferred or subleased to anyone else or sold at the time the trade fund is sold.

She has fixed : it is usually valid for 1 year or 1 season. The start and end dates are specified in the authorisation order. It shall be renewable or tacitly renewed.

She can suspended or withdrawn at any time by the municipality, without notice or compensation, in particular to facilitate the execution of works or the conduct of an event.

The AOT authorisation to occupy the public domain is payable.

If your application is accepted, you must pay a fee, called road.

The price varies depending on the following:

  • Scope of the terrace or surface of the display
  • Duration of use (annual or seasonal)
  • Commercial value of the street

The amount road may vary upon renewal of the authorisation.

Its amount is fixed by the municipality, to which you must pay the payment.

In the event of a change of business or transfer of trade funds, the authorisation ofAOT: titleContent is no longer valid.

As new owner or lessee, you have to new request AOT.
